Thuri., May 7, 195" Supreme Court Gives Nod To Home Health Inspectors WASHINGTON (AP) The Supreme Court has approved searches of private homes by health inspectors without war rants. The court split 5-4 in ruling on the case of a Baltimore resident who had been fined $20 for re fusing to admit to his home a city health inspector who had no search warrant. Justice Douglas said in his dis sent that "the decision today greatly dilutes the right of privacy which every home owner had the right to believe wai part ol our American heritage." Law's Purpose Traced Douglas said the protection of the Fourth Amendment has here tofore been thought to protect pri vacy when civil litigation, as well as criminal prosecutions, were in the offing. "The court misreads history when it relates the Fourth Amendment j primarily to searches for evidence i to be used in criminal prosecu tions," Douglas said. I nnuelas said that England, "a ! nation no less mindful of public health than we and keenly con scious of civil liberties, has long proceeded on the basis that where a citizens denies entrance to a health inspector, a search warrant is needed. "We cannot do less and still be true to the command of the Fourth Amendment which pro tects even the lowliest home in the land from intrusion on the mere say-so of an official," Doug las said. Justice Frankfurter for the ma jority said that "time and experi ence have forcefully taught that the power to inspect dwelling places, either as a mtter of sys tematic area-by-area search or, as here, to treat a specific prob lem, Is of indispensable impor tance to the maintenance of com munity health; a power that would be greatly hobbled by the blanket requirement of the safeguards necessary for a search of evidence of criminal acts." Today's decision was on appeal by Aaron D. Frank of Baltimore. The health inspector who called at his home asked admission after a neighbor had complained of rats in tne area. Canada Considering Alcan Paving Project WASHINGTON (AP) Canada is considering a proposal for pav ing the Alaskan Highway, Sen. Richard L. Neubcrger (D-Ore) said Monday. Canada also would be re quired to take over the mainte 1 Person Killed In Soviet Quake LONDON (AP) Moscow radio reported here one person died and 13 were injured in an earth quake on the Kamchatka Penin sula in the Soviet Far East. This was the quake recorded Monday by seismographs in Brit ain, the United Stales and other parts of the world. Buildings were damaged in the town of Petropavltwsk and in neighboring districts.
