He luled that the union was picket ing ior the purpose of influencing the Gilberisons to sign a contract with the union. ' Both sides cited numerous court decisions to uphold their positions. Tbe attorneys for the GUbertsonc also said that the anti-picketing section protects the right of em ployes to stay out of a union. The attorneys for the labor unions answered: "Broad sweeping prohibition! against peaceful picketing cannot be sustained. Prohibitions against peaceful picketing violate constitu tional rights." "It shall be unlawful for any person to picket any employe or employer unless such person has been certified or is recognised as the bargaining representative of such employer" under federal or state law. .. i . . Attorneys for the State Federa tion of Labor and State Industrial Union Council argued that section restricts peaceful picketing, and that it therefore denies free speech. East, Eugene, who held the heart of the law to be unconstitu tional. Two other circuit courts also have ruled the same wav. The dispute is over this section of the law: and Industries Committee attended the bearing.
