July 13. 1954 Accused Atry. General Also Labeled Lunatic BIRMINGHAM, Ala. W - SI Garrett, Alabama attorney gener al, wa charged Monday with fraudulent changing of votes in tht June 1 primary. A few minutes after his arrest, Jefferson Solici tor (prosecutor) Ernimett Perry filed hinacy proceedings against Garrett. The attorney general was in dicted on the vole fraud charge June 30 by a Jefferson (Birming ham) grand jury. He posted $1,000 bond after he surrendered at the sheriff'! office. After the bond was posled, the hinacy proceeding was (.led by Perry before Judge J. Riisscil Mc Elroy, presiding judge of the Juf ferson circuit court. A hearing was set for July 21. R asks the court to determine "the mental condition of the de fendant" as rapidly as possible. Garrett has been under psychiat ric treatment in a hospital at Galveston, Tex., since June 24. Garrett issued a statement in which he declared he had "violat ed no law, state or federal" and further that he had "committed no legal or moral wrong." The attorney . general, who Is Alabama's chief prosecutor, was a witness betore the grand jury hers which also indicted solicitor Arch Ferrell of Phenix City and Lamar Reid. chairman of the Jef ferson County Democratic Execu tive Committee, on the vote fraud charges. Tht three men were charced with altering the official vote for Lee Porter in the race (or attor ney general to add 600 votes for him. Porter was beaten in a close race with Albert L. Patterson, Phenix City anti-crime crusader. Patterson was slain June 18. a few days before he was scheduled to appear before the Jefferson grand jury to testify in the vole fraud inquiry. Coquille Gl Stabbed To Death; Wife Jailed CAMP HALE, Colo. AI -Duane A. Liven good of Coquille Ore., died in a Leadville hospital Monday after a stabbing in Ills quarters near this mountain Army post. Sheriff Clarence C. McMurrougn said the soldier's wife, Francos, formerly of pueblo, was held at the couniy jail in Leadville. She told the sheriff the couple had been "fighting and arguing all evening." The sheriff said Mrs. Livengood told him her husband had threat ened her and she stabbed him with a steak knife havins an eieht-inch blade, in their cabin court at Birdseye Flat, five mile east of Leadville.
