Stanton Public notice Is being given by the Oregon Kish Commission of i hearing to be held in Itortland, Wednesday, Feb. 11, at 10 A. M. in the commission's offices In the Governor building, to consider "The striped bass fishery in the t'mpqua Kiver and tributaries; its regulation and management." Interested parties, the Commis sion reports, will have the priv ilege of presenting their views regarding the matter. Statements and facts pertaining to the fish ery may be submitted orally or In writing. Written communica tions should be mailed in time to be recleved prior to the sched uled hearing. The Fish Commission's action follows a recent opinion furnish ed at the commission's request by Attorney General George Neu ner outlining the Commission's powers over the striped bass fishery. The opinion was written by Fred A. Miller, assistant at torney general, who, upon In structions from Neuner, has been making a special study of the l'mpqua fishery laws and regula tions, in which several conflicts, resulting from passage of two bills, Senate Bill .'116, and Senate Bill 140, by the last legislature have had both the Fish Commis sion and Game Commission in a quandry as to their respective powers. Authority Clarified The Fish Commission had as sumed that S. B. HO. the Author ity Bill, gave that body complete authority over the salmon fish ery, both sports and commerical. but the Attorney General ruled recently that authority over sports angling for salmon still remains with the Game Commis- ; sion, and tnat the t ish Commis sion can regulate only the com j merical fishery. Senate Bill 31G. I the L'mpqua Closure Act, makes I salmon in the Umpqua River a came fish, except when taken as "incidental catch" but permits gillnetting for striped bass. Through oversight, resulting from haste in crowding the bill thru the legislature in closing days of the session, the Act failed to" pro vide needed limitations. It omit- ted, for Instance, any provision i for deadlines, "incidental catch' was not defined, and no striped 1 bass seasons were set.
