Jackson SL practice, there Is not sufficient time to file an application and supporting data before the hearing October 5th. Manifestly any effort to bring the Modoc Northern case beforej the Interstate Commerce commission would meet with ob-' Jectlon which would probably be sustained by the Interstate Com merce commhwlon on the grounds that It would introduce new Issues. While the commission Is not op posed to construction of the Mo doc Northern, It Is opposed to ac cepting the Modoc Northern as a substitute for a direct trans-state line which It bt'lii ves to be of ut most importance to the develop ment of the entire state, but It Is our firm belief that both the Mo doc Northern and the trans-state line will be constructed. ''The commission must take a broader view and consider the needs of the entire state. May we direct attention to the fact that the Modoc Northern, which you state Is the most Important line in Oregon, would be constructed In California, while our application la for railroads In Oregon. The Mo doe Northern would shorten the present distance to eastern mark tts from Klamath Falls. The trans-state line from Odei; to Crane will ahorten the distance from Klsmath Falls to all points east of Granger fifty-seven miles nnder the- mileage of Ihe Modoc, A modern croas-etate line would shorten the distance two hundred twenty-seven miles shorter than the Modoc Northern from Western Oregon and afford more favorable grades, shorter distance, ch-aper construction, will afford transpor tation for territory not now served I equal In area In the state of Ohio connecting said territory by short haul to Portland, Oregon, afford abort haul transportation for all I points west of Mountain Horn In I Idaho to the Pacific roast and at the same time reclaim more than thirty millions ot dollars already 'invested In branch llnfs extending from the Columbia River to B?nJ jand from Ontario to Crane."
