With Indications of a. battle In the offing, the defense meeting was to determine upon what grounds it would base its plea for admission into the evidence the testimony of experts, scientific and religious lines, with the announced Intention of attempting to phow that the theory of evolution does not conflict with the Hiblical ' ac count of creation. While they were seeking a firm basts for their contention that such testimony would be relevant, prosecution attorneys were draw ing up their battle lines to with stand the expected attack. Indications today were that they would attempt to have this testi mony introduced as a matter for the information of the presiding Judge, to be dealt with afterward as he sees fit. Prosecution attorneys on the other hand consider the case one In which only the question ol whether or not John Thomas Scopes taught that man descended from a lower form of animal was involved. Basing their contention upon this view they have announc ed their Intention of making a su preme effort to prevent the trial from leaving the legal course and trailing Into a religious and scien tific controversy. "The only issue." Attorney-General Stewart said last night, "is whether or not Reopes taught that man descended from a lower form of animal." The administration of the oath to the Jury Monday, followfd by the reading of the Indictment and the arraignment of the dtfenilant will bring the opposing counsel to gether for their first ral clash In the trial. Symptoms of such a clash were revealed several iuies yesterday In the objections of Mr. Stewart to the manner of questioning pursued by Clart-nce Itarrow In examining prospective jurors. Mr. Stewart, both at a brh'f exthange of views of opposing attoi nryj and durlnr; the selection of the Jury, objectt-d strenuously to the fnji r ltn Into the trial of anything which would .indicate that it would develop into an attempt to reronrile the theory of evolution Hh the Illble. In a statement to the Associated Press last flight he said: "Since the defense has made known Its position concerning the competency of the proposed ?V. dente of srientlsts tending to show thnt there Is no mn flirt between evolution and the Itiblo, I think It but right that our posl'ion should also b definitely stated an I that it might be understood that we Intend to back our program as rigorous ly as we know how." Continuing he said it was his understanding that Hrop'-a would not deny he taught the hich school students that man descended from a lower order of animal. "If this be true," he said, "he Is guilty of the violation of the law and all th fvidenc of the scien tists within his reach cannot save hint. ' The law ItRclf says that it , shall not be tauglit to tho students j in the public schools that men des cended from a lower order of am , mal." Whether or not scientists might . h? brought into court to expound ; I he belief that mall descended from a lower order of animal by j i the process of God's creation, he f felt would make no difference, de-1 clarlng the law says such cannot be taught. Production of expert witnesses I by both sides, he said, "would lead j : to a never-ending proposition and, ! would in the end be but a babble j of tongues." j T K.l ('II KItM A SSfM'l A TIO AUK HAC K Oh' SCOIM.S.
