While they were seeking a firm
basts for their contention that
such testimony would be relevant,
prosecution attorneys were draw
ing up their battle lines to with
stand the expected attack.
Indications today were that they
would attempt to have this testi
mony introduced as a matter for
the information of the presiding
Judge, to be dealt with afterward
as he sees fit.
Prosecution attorneys on the
other hand consider the case one

upon this view they have announc
ed their Intention of making a su
preme effort to prevent the trial
from leaving the legal course and
trailing Into a religious and scien
tific controversy.
"The only issue." Attorney-General
Stewart said last night, "is
whether or not Reopes taught that
man descended from a lower form
of animal."
The administration of the oath
to the Jury Monday, followfd by
the reading of the Indictment and
the arraignment of the dtfenilant
will bring the opposing counsel to
gether for their first ral clash In
the trial.
Symptoms of such a clash were
revealed several iuies yesterday
In the objections of Mr. Stewart to
the manner of questioning pursued

In a statement to the Associated
Press last flight he said:
"Since the defense has made
