MAYNARD, lluilder, Phone, -Mli-L. the side Issues in the land grant for feiture suit of the lulled States against the Southern Oregon Com pany was decided yesterday by Judge Wolverton In the tutted States Dis trict Court, but the questions In volved In the main case were not passed upon. A number ot years ago Congress made a land grant In Douglas and Coo Counties as a sub sidy for the building of a military road from Coos Day to Roseburg. and one condition was that this land should be disposed of to actual set tlers only In small tracts at $2.50 an acre. Eventually the Southern Oregon Company obtained these grunt lands aud recently a suit was (lied by the Government for for feiture of the land because the terms of the grant had nut been compiled with. Prior to the suit the Southern Ore gon Company had been paying taxes on these lauds, but ceased when the forfeiture suit was instituted. Tax collectors, however, contiuued to as sess the property and in default of payment the land was advertised for sale. Then the Soulbern Oregon Company sought an Injunction against this tax sale until the suit was settled. To this the Sheriffs demurred and Judge Wolverton yes terday sustained the demurrer and denied the application for the In junction, for the reason that the de fendant claimed title to the land and did not recognize the Government's claim. This decision, It Is said, will cloud titles to the land whichever way the main suit may be decided. If the Government wins, all money paid for taxcB or tbe money paid for tax titles will be lost, and If the Southern Oregon Company .wins it will have to redeem the tux titles. The guardian declares he has had a diffi cult task In straightening out the financial tangles of Vial, and that debts are still unpaid.
