It la jiohh lb-Jo to dlBband or transfer one of theae battulioiw, and maintain tho other ua a bu pa rule bat talion, since the law govurnliiK the regular army recognlzcm a separate battalion as a completed urbanization and not as a part of a rcKlment. Hut two battalions doslgnuted as a regi ment Is considered by the secretary or war to be aa incomplete organization, and therefore will not be ulluwed to remain a part of tho National Guard after January 21, 1910, IncreaHo t'nuMt Artillery Kewerven. - 1 The policy of the war department Is to increase the coast artillery re serve by transferring a portion of the National Guard Infantry of the three Pacific states to the artillery branch of the service or by organizing new artillery companies In those states. Bo to meet this requirement of the war department and at the same time comply with the statute of January '21, 1903, It Is altogether probable that Adjutant General Hnzer will effect a transfer of at 'least one bat talion of the Fourth regiment to the artillery branch of the service with in the next six months. . The Fourth regiment Is composed of eight companies located at the following stations: Ashland, Hone burg. Cottage Grove, Albany, 1)uIIuh, McMinnville and two companies at Kugene, with regimental hendquur tera at Eugene. It wlLI not be the policy of General Flnzer to arbitrarily require an In fantry company to transfer to the artillery service. The wishes of the Infantrymen will bo commltcd In the matter, although It may ben neces sary to muster out of the service companies that decline to enter the artillery. Washing to n Uunrd Increased. Radical action providing for an Increase In the artillery branch o the Washington National Guard has been taken by the adjutant general of that state, who has Just Ihbium! an order requiring all the Infantry or gaivizatloiiB west of the Cascade mountains to tnu.wfer Into artillery, companies in order to comply with tho demand of the war department, for the Increase of the coast artillery reserves. It Is not believed that such a sweeping change will be made In the National Gunrd of Oregon, as has been ordered by the adjutant general i of Washington, but it is practically certain that the next few months will witness the breaking up of the Fourth Infantry and the organization of either four or eight new comimnles lor the coast artillery reserve. When seen today Adjutnat Gen- era) Flnxer declined to state just Uo j he would proceed In complying witn . the statute or January 21. l'.HKt. liu' admitted that It might, become neces : sary to muster out one battalion of 1' the Fourth Infantry In cose the ' guardsmen declined to enter tho ar S 4lllery branch of the service, (ien k: eral Flnzer expressed the opinion 1 that tho war department would be - greatly pleased and the efllclency of . tho National Guard largely Increased by transferring both battalions of the Fourth Infantry to the coast ar tillery reserve. July 20. On the ground that among other things, while courts have discretionary pow- erB In the exclusion of the public from the courtroom during the pro gress of a trial, it is not an unlimited discretion, and that the exclusion of the public from the courtroom dur ing the trial of Heck Osborne, upon a statutory offense charge, and over his objection, by Judge O. E. Davis, of the Circuit court for Malheur coun ty, might have been prejudicial to the Interests of the defendant and violative of his constitutional right to a speedy, public, fair and impar tial trial, the decree of conviction against Osborne Is reversed and a new trial Is ordered. The opinion Is written by Justice King. Justice King holds that a court may properly exclude certain classes of persons from, a trial, the details of which may be detrimental to their Jnterests, but that to exclude the entire public from the trial smacks too strongly of the old English "star chamber" proceedings, and is a pre cedent that will not be countenanced. Pointing (ami Auuiiilt. Holding that when a pistol is used In a holdup for the purpose of Intim idating the victim It Is presumed to be loaded and would be used in de fence in case of resistance, and that the burden of the proof that it was not loaded rests upon the holdup man and also that in such case the re volver could be legally construed as a dangerous weapon, the Supreme Court ,ln an opinion by Chief Justice Moore, upheld the decree of Judne Bean, of the Circuit Court for 1'ma' tiHa County, in the conviction of Joseph Harr and Samuel Gaston of assault and robbery upon Peter VVil- cox, being armed with a dangerous weapon.
