Malar key, one of the attorneys for the de fense, made a protest in the federal ' court to Judge Wolverton UiIb morn InK. Malarkey informed the courl that the witnesses were being round ed up by tho prosecution, when their eiimmona did not call for It, and he wanted the defense to have an oppor tunity to examine the witnesses. The defense does not appear to be exactly satisfied with the manner in lug for the trial of ex-Htate Senator it. A. Booth, ex-rocelver of the laud office at Rnseburg, .lumen Henry Booth; and T. K. In vcstlgatlon disclosed thnt the trou ble started by tho statement of Tip ton, who was brought before Me Court and Neuhnusen for an examin atlon. The witness stated thnt hi had made the remark to Muhirkc? ob a Joke, and was cautioned not ti be runny along similar Hues again. Another complaint made by Ma larkey Is that ho went lo Kosehuri Saturday to look Into the case, am' that every man he spoke to wat aerved with a Rubpocna as a witness The federal oRlcials say that the mn were not summoned because Malar key happened to speak to the vert men tho government had served wltl subpoenas last Thursday, two dayi before the Portland lawyer arrived at Itoseburg. A demand was made by Malarkey on McCourt to be allowed to be pres ent when the United Stntes District Attorney examined the witnesses tot the prosecution. This McCourt re fused. McCourt said ho would not permit tho attorney for tho defensi to attend any examination he wai conducting, and added that Malarkey could Interview all tho governmeni witnesses, and that he, McCourt, did not want to bo present when Malar key was doing tho examining. While tho government witnesses are not compelled to report tn tin United States District Attorney 011 their arrival In Portland, nil have done so. He is charKed with organizing a fraudulent Ben en k for acquiring Heveral thousand acre of valuable tlmberlandu n eastern Oregon. Cooke's alleged plan of operating BitrpaHKfd the nervy land-grabhlng tactics heretofore employed In thl state by C. A. Smith and other mil lionaire tlmberland speculators of Mlnneftota and Wisconsin, to say no thing of those of the smaller loot ers, which were disclosed In the put lie land-fraud investigations. Cooke Is said to have operated in Oregon under the name of the Oregon Hunching & Timber Company, and It Is reported, In the execution of h1J scheme brought a carload of New York people out her to enter on tho desired lands. Hrldgea at the upper end of to-vn wero carried away, sidewalks and fences swept down the streets, and many houses filled with two or three feet of water, the receding flood leav ing behind a trail of mud and debrK Several houses were partially wreck ed.
