Salem, Or., March 11. An exam
ination of the laws creating the State
Normal Schools seem to show that
these schools are as much state institu
tions as are the Reform School, Mute
School and Blind School and that there
is authority for their continuance even
though the appropriation bill should be
held up by a referendum petition.
Advocates of the referendum move
ment expect to out off the Normal
School expense along with some others,
by filing the petitions, but there seems
to be as much authority for continuing
the Normal Schools as there Is for the
Blind School or Mute School.
Under the statutes and the decisions
of the courts, the Secretary of State 1b
bound to audit claims wherever there is
a lsw in existence authorizing the ex
pense to be incurred. An examination
of the law on the subject therefor be
comes important.
The law creating the Drain and Ash
land Normal Schools is contained in
sections 3501 to 3509 of the code. The
act provides for a Board of Regents,
consisting of the State Board of
Education and nine members appointed
by the Governor on each board. Sec
tion 3505 defines the powers and duties
of the boards, among which are the
following:
"To appoint and employ a president
and vice-president of said school and
such professors, teachers and employes
as may be necessary, and to prescribe
their duties, compensation and tenure
ofolliceor employment."
The Weston Normal Is governed by
sections 3400 to 3500 of the code. Sec
tion 3500 gives the Board of Regents
power similar tD that quoted regarding
the Drain and Ashland schools, and it
Is also provided that tho board shall
have power "to purchase any needful
and properapparatus, books orarticlos,
and to provide for all necessary fuel
and other supplies for use in the
school."
The same power to employ teachers,
fix their compensation and tenure of
employment Is conferred upon the
Board of Regents of the Monmcuth
Normal.
Tn the case of the Monmouth, Drain
and Ashland schools, authority Is given
to expend "any money belonging to or
appropriated for such schools, and in
the case of the Monmouth Normal, it Is
specified that the expenditure shall be
"according to the terms of such gift or
appropriation," but these provisions do
not appear to bo a limitation upon the
power to employ teachers and fix
salaries.
DUNBAR MAY NOT AUDIT BILLS.
Though the laws creating the normal
schools authorize the boards of regents
to omploy teachers, etc., it has always
been the accepted ruling that this au
thority depends upon and is limited by
an appropriation. In 1807, when the
Legislature failed to organize, Secre
tary of Stato Klncald refused to audit
claims from the normal schools, and no
suit was brought against him to com
pel him to pass upon tho claims pre
sented, The normals were conducted
without any aid whatever from the
Btate, until tho special session of 1S97,
when tho Legislature appropriated
money to pay the expense incurred
during the time when no appropriation
was available.
Because the law has always been
construed by state otlicials as not
authorizing expenditures for the
normals unless appropriations have
been niado therefor, and such con
struction was acquiesced in by the
normal school people in 1897-98, Secre
tary of State Dunbar will not audit
claims for these Institutions if the ap
propriation bill should bo holdup hy

Special session of the Oregon Legis
lature to consider the general appro
priation bill, particularly that part of
it relating to normal schools of this
sta e, rests entirely with the membera
of the Legislature and with the people
of the state. Governor Chamberlain
this morning declined in unmistakable
terms to take the initiative in the mat
ter, and said in effect that he did not
think the appropriation bill needed re
