Quoting from the Oregon laws Mr. Brown Informed a News reporter of tho fact that any person under tno age or HI years who shall frequent a resort similar to those above mentioned and rep resent that he Is over tho age of 21 years, Is liable to a fine of not less than $10 or more than $100, In de fault of which the person convicted; may be compelled to serve the a) ternate in the county jail. From Mr. Brown's conversation it would appear that he Is desirous of pre venting uiiricuity rrom such source. Learning that tho grand' jury had returned an indictment charging him wiui i no crime or oeiacmg a cabin, Km mitt Overman, a mining prospec tor who has resided on North Myrtle Creek for the past few years, arrived In the city this morning and shortly thereafter mude bis whereabouts known to Sheriff Fen ton. A com plaint was lodged against Overman at a recent session of the grand Jury, when George Carlon, who now ap pears as the prosecuting witness, al leged that Overman had visited his homestead, situated on North Myr tle Creek, and shattered his esbln rendering it unfit for ociipancv. Further Carlon claimed that. Over man had no legal rlgnt to trestK on the land upon which tp pnbln .was erected Inasmuch as be hud filed upon It under the homestead law. Overman, on the other hard, alleged that he owned the property, having filed upon It prior to Carlon under the mining act. ., owing to ttie ract that the circuit court jury has been discharged it is probable that Over man's case will go over until the May term of court. Accordingly he will be placed under bonds to appear at that time. WANTS RAILWAY MERGER TO STAND (Special to The Evening NewB) Washington, D. C, Jan. 21. At torney General Wlckeraham today granted Robert S. Lovett, chief of the Harriman interests, permission to file written memorandum in support of his request that the government dis miss the action which has for Its pur pose the dissolution of the merger of the Union Pacific and Southern Pa cific railways.
