morning the grand jury Is still grind
ing away. Indications tending to show
that they will continue In session mi

tor who has resided on North Myrtle
Creek for the past few years, arrived
In the city this morning and shortly
thereafter mude bis whereabouts
known to Sheriff Fen ton. A com
plaint was lodged against Overman
at a recent session of the grand Jury,
when George Carlon, who now ap
pears as the prosecuting witness, al
leged that Overman had visited his
homestead, situated on North Myr
tle Creek, and shattered his esbln
rendering it unfit for ociipancv.
Further Carlon claimed that. Over
man had no legal rlgnt to trestK
on the land upon which tp pnbln
.was erected Inasmuch as be hud filed
upon It under the homestead law.
Overman, on the other hard, alleged
that he owned the property, having
filed upon It prior to Carlon under
the mining act. ., owing to ttie ract
that the circuit court jury has been
discharged it is probable that Over
man's case will go over until the
May term of court. Accordingly he
will be placed under bonds to appear
at that time.

MERGER TO STAND

torney General Wlckeraham today
granted Robert S. Lovett, chief of the
Harriman interests, permission to file
written memorandum in support of
his request that the government dis
miss the action which has for Its pur
pose the dissolution of the merger of
the Union Pacific and Southern Pa
cific railways. Wlckersham has
promised to take the memorandum
under consideration.
