It flliall he the duty of all road mi- iorvisors in each road district in any iouiily in Huh htatc, in addition to he duties heretofore picsctibed by n w, to ascertain from time to time ind know whether or not there is any water running or flowing in or upon liny county road or loads within his distiict, ns overflow or scepngc from nny inanition or other ditch owned by nny perhon, compnny, or corpora tion, mid he fslinll, iib he ascertains that there is any such water seeping or flowing, or running upon any such county load or roads, notify Hie owner or occupant of such ditch or ui the water thcieiu contained, in writ '"k'f by personally serving on such owner, occupant or UHor of such ini gatiou ditch, or other ditch, n written or printed notice that the water in the irrigation or other ditch so owned by said peron, company or corpora lion, in seeping or overflowing, or flowing on the county road or county roads of his distiict, at n point or points on Hiu'd road or. roads more particularly described in said notice with reference to said irrigation or other ditch or any natural or arli licinl object or objects, which said shall fuithcr notify such owner, oc cupant or liner of said inigation or other ditch of the water flowing therein, that such seepage, overflow ing or i lowing of said water must be stopped within six hours of the ser vice of Hiiid notice, as aforesaid, and notifying said owner, occupant or user of such irrigation or other ditch, to within six hours from the hour of the service of such notice, have this said water diverted from said county road or roads, and to keep said water diverted from said county road or roads, and to keep said water from again seeping, flowing or over flowing upon said county road or roads. (I,. 11)07, C. J (15, Sec. 1.) Sec. 'J49. Supervisor to Divert Water fioin County Koitd, Where Owner Fails to Do So. If such owner, occupnnt, or user of said water shall fail or refuse to remove or divert Miid water from said county load or roads. Within six hours after being notified by the road supervisor of the existence of such water in or upon said road or roads, then it shall be theduty of such rond supervisor, and hv'f.hiill have author ity to go npoii thai. pint of the land upon which said irrigation ditch or other ditch is situated, through vvlituli snid water has been conducted, or is being conducted, calling to bis as sistance such help aw he may deem neccMsnry to cause said water to be diverted from and removed from snid county road or ronita, in the mnnner which to him iiecms moU effective and that will most speedily lemove nnd withdraw said water fiom snid county road or roads, and that will prevent the said water or any water in said irrigation or other ditch from rolurniiig upon or overflowing said county road or ronds. Upon the completion of said work, tho road su porvihor will tile with the county clerk of the county in which such road or ronds are situated, an itemized state inent of the time occupied by hira nnd his t'ssistnnts, and the reasona ble- compensation for diverting and removing said water from said county rond or loads, together with the name of the owner nnd occupant of the land on which said irrigation or other ditch which brought said water to said county road or roads, is shu nted, together with the date and hour when said notice was served on such owner or occupnnt of said land, ver ified by his oath, and when said statement is filed, tho county clerk shall cnue the same to be entered ui)on the lien docket prepared for that purpose, nnd the nmount of such charges and expenses, when so dock eted, shall constitute a first lien, prior and superior to nil other liens or charge- on said land or premises, excepting lu.es. If such charges and expenses nre not paid, and said lien discharged b.v the owner or occupant of said lands, within sixty days after the same is docketed, it shall be the duty of the district attorney in which said coun ty is situated, to biing suit in the name of the said entity for the fore closure of said lien, and the lands af fected thereby shall be sold under e edition for the payment and satis faction of such charges and expenses of said lien, and all charges touching Iho same. (L. 1907, C. JG5, Sec. 2.) Sec. 250. County Coutt to Pay Supervisor. If within ten days lifter the state ment has been filed and the lien dock eted, ns provided for in section 2 hereof, no objections having been filed thereto, the county court sliull pay tho supervisor out of the county funds the amount of such charges and expenses, and the same shall be thereafter recoveied to the use of the county as in the foregoing sec tion provided.
