Gesebai Land OjncE.r Washington, D. 0., Dec. 13, 18S8. J Registers and Receivers U. S. Land Office, Gentlemen: The rules heretofore in force relative to the admission of entries and filings on lands se lected (and prion to their approval and certification by the secretary of the interior) as "swamp and overflowed and rendeWd thereby anlit for cultivation," are hereby modified as follews: 1. When any settler upon such lands or applicant to enter the same under the public land laws, accompanied by a statement un der oath corroborated by two witnesses, that the land in its nat ural state is not swamp and over flowed and rendered thereby un fit for cultivation, the register and receiver will allow such filing or entry "subject to the swamp land claim." 2. Upon tho admission of any such filing or entry the register will at once notify the governor of the state thereof, and allow him sixty days within which to object to the perfection of the entry and to apply for a hearing in behalf of tho state to prove the swampy character of the land. 3. When a hearing is ordered between the state and claimant un der tho public land laws, tho bur den of proof will be upon the state to establish the charaoter of the land. 4. When no protest or applica tion for a hearing is presented on the part of the state, as herein provided, the state will be deemed concluded from thereafter assert ing a claim to the land under the swamp land grant. 5. The foregoing applies only to those states whose claims are adjusted by examination in the field. 6. Where swamp land selections are based upon the field notes of survey, and the land is alleged not to have been in fact swamp and overflowed, and rendered thereby unfit for cultivation at the date o the swamp land grant, the burden of proof will be upon the contest ant or adverse claimant under the public land laws. 7. You will promptly advise this office when notice is given th governor in any case, stating ih" date of such notice, and the de seription of the land involved. At the same time the hope is expressed that the United States government will not take the course which the recent legislation indicates, until every means of coming to a lair and friendly settlement is ex hausted. Senators who took part in the discussion on Monda3T distinctly recognized the fact that the retaliation bill is a notification and u menace, which, under certain conditions of public feeling, would lead to war with Great Britain. In defense- of American rights we are about to take a position from which we shall not recede. The alternative of peace or war lies with Great Britain. Pluck and patriotism rang out in the senate chamber on iLonday. Tho tall: of var was not rid, -ilous, for id is j isiiiied by the outi.irres to which our fishermen have been subject for nsonths at the hands of Dominion cruisers, and nations havo been embroiled before this for iess cause. Our coasts are defenselesa, our great cities are at the mercy of the first coiner. The enemy that comes may be a ruffi an among nations, a coward, a bully, selfish, and rapacious, and, nevertheless, may bring guns ca pable of raking Manhattan island. Let not congress neglect its duty any longer. While firmly and fearlessly maintaining American rights as against Great Britain or against the world, let the senators aud the representatives in congress remember that firmness and fear lessness are not the only ways of manifesting patriotism."
