R. & N. ASKS THAT STREET BE VACATED PETITION IS PRESENTED TO CITY COUNCIL Council Is Divided Over Proposition Final Action Next Week Citi zen Want West Court Street Im-prOTrd. A petition from the O. R. & N. company asking the city to vacate certain portions of Aura and Lilleth street was presented to the council last evening. Councllmen Stroble and Brock of the street committee earned a favorable report on the pe tition but Councilman Sharon, the other member of the committee, re fused to recommend the vacation of the streets without further Investiga tion. The matter was passed over un til the next meeting of the council for final action. A special meeting of the committee will be held in the council rooms Tuesday evening. Nothing was said in the petition about making Pendleton the freight division point in case the request was granted and for that reasan Council men Sharon, Strain and Dyer seemed inclined to hesitate about giving their consent to the proceedings. The petition alleged that the railroad company owned ail the abutting property that would be affected by closing the streets and stated that the public demanded that the streets be vacated as petitioned for. Riils for Hose Opened. Bids from five different companies for supplying 500 feet or fire hose to the city were read and referred to the fire committee and the chief of the fire department. The prices ranged from SO cents to tl per foot. Want Court Street Improved. G. I. La Dow, representing a num ber of West Court street property holders, appeared before the council last evening and asked that steps be taken toward improving . West Court sstreet. He asked that It be done as soon as possible so that the street could be put In condition before win ter arrived and stated that if neces sary, the property owners would be willing to bear a part of the expense. The request was referred to the street committee by Mayor Murphy without comment. Wants Lower Ucenj Fixed. The proprietor of a steam popcorn cart appeared before the council and asked that a monthly or quarterly li cense be fixed for his business. He declared that the present license of J 3 per day was exorbitant and more than he was able to pay. Two t; to Teiiltcntlary. . A. Hyther, sentenced to serve i two years in the penitentiary for I stealing a horse from the City stables and William Evans sentenced to serve two years for stealing a number of elk teeth nd other articles from an Indian tepee on the reservation, were taken to Salem this morning by Sher Iff Taylor. Maier versus Vernita Sweaza et al. Is the title of a suit filed in the circuit court last evening and in which Maier seeks an order from the conrt. directing that certain property in this county belonging to the estate of Christian Maier, de ceased, be sold instead of partitioned among the heirs. Christian Maier was a resident of Walla Walla and when he died left property in Oregon as well as Washington. NEW MANIFESTO AGAINST POLYGAMY IS PROBABLE Salt Lake, Oct. 6 Joseph Smith, head of the Mormon church, it is be lieved, sounded the keynote of the three day semi-annual session of the Mormon church today when he de clared certain practices among the Mormons must cease. Thousands of Mormons representing nearly every state In the Union. Mexico and Can ada, are here. It Is rumored a new manifesto on polygamy will be issued before the session adjourns. The Des- eret Xews, the church's official or organ, today printed a list of several prominent Mormons wno are excom municated . They are accused of per forming plural marriages. FIENDISH ATTEMPT. Robbers Drug Woman, Place Her In Pool of OH and Place Lighted Candle Nenr, Oakland, Oct. 6. This city Is aroused by the attempts of fiends to burn Mrs. E. H. Sweetzer to death at her home at Elmhurst, a suburb of this city this morning, after robbing her house. When Sweetzer returned home early today he found his wife drugged and unconscious and lying on the floor In a pool of kerosene. A lighted candle was In the kerosene. He extinguished it just before it reached the oil. The house had been robbed and everything of value which could be carried away taken. The weman's condition is precarious. JEALOFS GIRL rsEs GCN ON HER LOVER Newlyweds Stop Here. Mr. and Mrs. W. G. Shuham, who were made man and wife in Walla Walla Tuesday night, were In Pendle ton yesterday en route to Portland and Seattle, where they will spend their honeymoon. Mrs. Shuham was formerly Miss Anna Ennis of Walla Walla, and has many friends In this city who were surprised to hear of her marriage. The groom is the cash ier of the First National bank of i Waitsburg, Wash., in which city they will make their future home. Pan Francisco. Oct. 5. Guldo Bar ssl, aged 19. was shot and fatally wounded in front of a local hotel early today, dying two hours later. Effie Wilson, a young girl employed in a dance hall, confessed at the emer gency hospital, where she went to take a last look at Bars), that she had shot him, although Barsi, who was then on the operating table, attempt ed to deny the statement. Jealousy Is supposed to have caused a quarrel between the two that lead to the shooting. Having heard of Pendleton from thousands of miles away, James G. Auld, a business man of Hong Kong, one of the famous "treaty ports" of China, arrived in Pendleton yester day morning for a brief visit and reg istered at the Pendleton. Mr.. Auld said he had business on the Pacific coast and had concluded it was about time to return to his home. First, however, he wanted to see Pendleton. Auld asked about the population. He commented on the prosperous na ture of the city and generally made himself cognizant of conditions here. He said he was almost inclined to in vest in Pendleton and he queried as to realty value. Mr. Auld will leave tomorrow morn ing for Portland. He said it was with regret as he did not care for the damp Portland climatic conditions, but he could not praise eastern Ore gon's present weather too highly. To Demonstrate New Suction Cleaner. Wade, son of Mr. and Mrs. E. T. Wade, will arrive here this eve ning accompanied by his bride of a week. He was married at Coos Bay on Wednesday, September i8 to Miss Margaret Beatrice Murphy, a young lady of Marshfield. They are now upon their wedding trip and expect to visit several days with Mr. Wade's parents in this city. Since ..leaving Pendleton several years ago Mr. Wade has been living at Bandon where he is practicing law and Is serving as city recorder. Says Husband Cursed .Her. Precious Hung has brought suit for divorce against Peter Hung, alleging that he gets drunk, charges her with misconduct, curses her and threaten ed to "smash her head off." Hung Is a well known reservation farmer, residing near the Catholic mission. They were married in this city in No vember, 1901, and have three chil dren, Emma, aged 7; Anna, aged 6; and Willie, aged 4. Mrs. Hung asks for $150 with which to pay the ex penses of the suit and $35 per month alimony. "Slured" Her "Relations." Declaring that her husband "slur ed" her "relations," conducted him self unbecomingly about the house nnd was uncleanly at the table, Mrs. Sarah F. Jones has brought suit for divorce from her aged husband, Mad ison Jones and asked the court to give her back the name of Sarah Hanes. BARR WILL ENDEAVOR TO FIX RESPONSIBILITY Coroner Empanels Jury Which la Ta king Testimony First Meeting This Morning Will Examine Eye Wit nesses TIUs Evening. For the purpose of fixing the re sponsibility for the death of Mrs. Ed Barr, who died yesterday morning as a result of the Injuries received in the automobile accident on the afternoon of September 26, Coroner Folsom em panneled a grand jury this morning, which is now engaged in making a full and complete Investigation of the accident. The jury held a short ses sion this morning at 11 o'clock, took the testimony of Dr. I. U. Temple with reference to the cause of death and then adjourned until 7:30 this even ing. The members of the iury will then meet again and examine all the eye witnesses to the fatal accident, who can be found and subpoenaed to ap pear at that time. It Is probable that only a small part of the testimony can be secured this evening and that other witnesses will be examined to morrow. Owing to the large number of persons on the streets at the time and to the fact that no two eye-witnesses have yet appeared who are able to tell exactly the same kind of a story concerning the happening, it may be several days before a verdict is reached. The members of the Jury are A. J. Gibson (foreman), George Hamblen. James Crawford, L. E. Frank, D. B. Waffle, J. E. Montgomery. Dr. Temple testified that the Imme diate cause of death was peritonitis, which In turn was the restilt of the Injuries received when the woman was crushed against the wall by the automobile. District Attorney Phelps or his dep uty, Frederick Stelwer, will be pres ent at the succeeding sessions of the grand jury and it is probable that McBee, owner of the auto will also be' represented by attorney. Her recent communication announcing her success in reducing radium to the form of a metal was sent by her to the Academy of Sciences by the hand of another just when she was on the eve of hastening away to an obscure vil lage by the sea for a rest of a couple of weeks. , Thence she returned to her unpre tentious home at Sceaux for a few hours last Sunday, and then proceeded to Brussels to visit the International Exposition. Her paper before the Academy of Sciences was extremely laconic. Its substance has already been fully cabl ed to America. Madame Curie re fused to add anything to it by way ot explanation, and her aversion to newspaper Interviews seems never to have been more intense than now. Attempts were made after her return to Sceaux to induce her to give fuller Information of her remarkable dis covery, but in vain. The world will doubtless have to wait for fuller in formation, that it ardently desires, until she -has made a further com munication on the subject to the ac ademy. , Have money by reading today's .ds. Flights In Spokane. Spokane, Oct. B J. C.. ("Bud") Mars, the aviator, made four flights here today at the Spokane Interstate fair grounds, staying in the air, all '.:'d. 31 minutes, and reaching an al tl'.ude of 1600 feet. He claims to have established a world's record for high glide, cutting off his engine at his highest point of flight. On one of his flights he carried with him as a passenger, C. N. Cosgrove, manager of the Minnesota state fair, who Is here visiting his son, Robert Cos grove, secretary of the Spokane fair. The exhibition was spectacular In the extreme.
