THE STATEMENT MADE by The Times that the parties Interested would find the courts a poor place to settle the municipal difficulties has been quickly verified. For four days a number of Marshfleld business men have been making an effort to have the city council troubles settled out of court. They were successful in adjusting tho difficulties to tho satisfaction of everyone except the lawyers and they blocked the whole affair. As a result of the combined and commend able efforts of Tom Nlcols, C. C. Going, Dr. J. T. McCormac and Hugh McLain the municipal tangle was straightened out. Messrs. Carleton and Haines agreed to resign, the city council agreed to accept the resign ations and Mayor Straw agreed to appoint two other men that would be acceptable to the council body. The business men's committee felt flat tered over their successful work but just at this juncture C. F. Mc Knight, attorney for Messrs. Carleton and Haines, entered the tribunal and the dove of peace flew out the window. Everyone else was satis fied but Mr. McICnlght refused to bo comforted. He deslied In addition to the other concessions and adjustments that the writ of mandamus be made perpetual and that the names of Carleton and Haines be enrolled as councilmen and the records show their membership from date of ap pointment until the time their resignations became effective. It was one of those legal quibbles and technicalities that, as Hugh McLain remark ed at the council meeting, is rather confusing and complex to the lay mind, but it proved to be the .bogie that frightened the peace dove. The question now goes to the district court for solution and what ever the finding there It will be carried to the supreme court for final arbitrament. This Is according to the announcement of the attorneys for both sides each seeming to think tlmt his contention must be upheld. The situation isi regrettable. The Times however, greatly mistakes the temper of the people of Marshfleld If they will permit all city affairs to be blocked while attorneys flight and clash to sustain the pride and passions and porsonal prejudices of three or four lnd'vlduals. The "Re call" was placed upon the stntute books of Oregon for just; such an emergency. City affairs bavo already been tied up too long. Business of all kinds Is suffering as a result of the condition existing In the city council. If these conditions cannot be corrected by the mayor and council, and they have confessed their failure, it is up to the people to settle the matter. Tho quibbles and technicalities of courts are confusing but there Is no mistaking, the verdict of the people at the noils. ' "A man convinced against his will Is of the same opinion still applies with aptness and force to the existing situation and if the gopd offices of mutual friends cannot secure harmony, the mandates of a court can not enforce It. The only logical and satisfactory solution of the present situation in municipal affairs is the Recall. The sooner the people realize this, the sooner city affairs will bo placed on a safe and satisfactory basis.
