Us w y. WATTS CASE FAILS Court Instructs for Lawyer After Hearing Testimony. CHARGED WITH TAKING BAIL fldrnc nd Indictment t Vari ance In Case Wherein Dr. Eisen Alleged Bond Had Been Substituted for Cash. Tha grand Jury Indictment, ehnrglns; John T. Watts, a local lawyer, with con erttn ball money of Dr. William T. Eisen to h! own uss, h been swept aside. Judge Morrow, Jn the Circuit Court yesterday afternoon, directed the Jury which was hnrneled to try the can to return a yerdlrt of not ffullty because the erldence was t -rarfanco with the charge In tho Indictment The motion for a non-salt was made by the defendant, represented by Judge Thomas CDay, John Dttchburn and W. TC. Banks, after Dr. Elsen had testified that Warts stole the County Clerk's re ceipt for the ball money from Eisen's desk, and then went to the Courthouse and obtained a check for the I1O0O. In lieu thereof Watts deposited with Dep uty County Clerk Smith a bond of JIMO. Mr. Smith testified yesterday morning that this transfer wis made January 21 Dr. Elsen iald that he was In Los An geles when the substitution of a paper bond for the cash wan made, and that be knew nothing of It at the time. Dr. Elsen was asked regarding bills which Watts owed him, and of money which Watts borrowed. It Is Watts" contention that ha consulted with Dr. Klsen before wlth dawlng the money, and that he kept It be cause the physician owed him for legal services. The case In which the ball money was deposited and then withdrawn was that Jn which Dr. Elsen was charged with con tributing to the delinquency of Jennie Signers, a minor, by performing a crimi nal operation. It is a coincidence that Judge O'Day fined tho doctor 10 upon his conviction, and also appeared yester day to defend Watts. Another coincidence was the fact that the case was tried before Judge Morrow. Judge 0'Day"s suc cessor. Deputies District Attorneys Vree Isnd and J. H. Page prosecuted the case. The Jury was composed of the following: O. P. Potts. H. W. Foster. W. H. Donahue-. P. K. Brig-ham. E. O. Magoon, W. W. Clark. H. Baumann. H. F. Taylor. B. B. Pske. I. Brunn, H. Bruck and John Dan nelles. GAS-PIPE THUG TO BE TRIED Jack La' Koe Will Face Jury on Mtirdor Charge. Jsrk U Rose, the gas-pipe thug, is to be tried before a Jury In Judge Morrow's department of the Circuit Court today. He is charged with the murder of Hyman Neuman in the lat ter's pawnshop at Second and Couch streets on the morning of May IS. On that dr about. 11:30 A. M.. Neuman was found lylnc wounded. In a pool of Mood on the floor. He had been beat en over the head with some Blunt In strument. At the time no motive was assigned for the crime. It developed afterward that a watch had been stolen from the store. .May 13 a Chinaman on Ankeny street rear Second, waj beaten over the head, and a crowd captured I a Rose, the as sailant. After La Rose had been ar rested It was found that he had pawned a watch, and detectives lmmedltately looked over tlu books of Neuman's pawnshop, and It Is said, found that the same watch was at one time In the second-hand store On May U, the day before the Neu man murder. A. B. Herman was struck ever the head. C. W. Wagner was ar rested on suspicion, but released after Herman had seen him. La Rose la also suspected of this crime. Lester W. Humphreys and Jay H. Vpton appear as counsel for La Rose while John K Logan has been employed as special prosecutor by District At torney Cameron. J. J. Fltagerald will represent the state. OT TO COLLECT VEHICLE TAX City Enjoined Again Until Consti tutionality Is Determined. The city officials have been restrained sain from collecting the vehicle tax. authorised by vote of the City Council. Judge Gantenbeln. of the Circuit Court. Issued an injunction against the city, A. L. Barbur. Mayor Lane and Chief of Po lice Grltxmacher yesterday. Until the constitutionality of the vehicle tax ordi nance is passed upon by the Oregon Su preme Court, these officials may not col lect the tax. The matter was brought Into court this time upon the complaint of John Talt that notwithstanding the fact that the case In which Ueorge Long sought to have the ordinance declared Invalid. Is on appeal before the Supreme Court, the city has been proceeding with the col lection of the tax. Attorneys Martin Watrous and Frank F. Freeman represent Talt. Petition In $10,000 Estate. Petltton that Harry L. Kingsbury and Oeore L. Kingsbury be appointed administrators of the estate of Jesse L. Kingsbury, who died October 6, was filed In the County Court yesterday. Mrs. Kingsbury left rroperty worth about JlO.OoO. but no will. Besides the two sons who are named In the petition as administrators, the heirs are: Edith, Nettie and Thomas Kingsbury. Mortgage to Be lYrecloed. Judge Ganter.beln. of the Circuit Court, decided yesterday that the mortgage of M. F. Brady on the premises of Lawrence Savles' heirs should be foreclosed. The property Involved Is one-half of lots 6 and . block 1. M. Fatton tract. Sub division L. The mortgage was for t-00. MOUNT SCOTT WOULD COME Annexation Favored Now That (he Water Bonds Are Legal. At the regular meeting of the Mount Scott Improvement Association. Monday night, at Arleta. Charles tout presid ing, the majority present strongly fav ored annexation to Portland. There was a general discussion of the subject, sev eral who opposed coming Into the city speaking favorably now that the water bonds had been declared legal by the Supreme Court. They explained their reposition to annexation at the election lt June on the gTounds that the water bonds were then in Jsopardy and they could -not see how the district could fat any benefit through annexation at that time. . " Even If It should be two years before the Mount Scott district can get Bull Run water, the speakers contended that It would be better to come Into the city in November, as a postponement of an nexation might make it four years before the people can get Bull Run water, and there would be continuation of the water shortage of last Summer, but greater each year. It was the Judgment of the association that something must be done to improve the car service on the Mount Scott line. The service was declared to be less sat- ...... ,an ever before. SITE BOUGHT FOR BUILDING C. S. MORSE PATS SS7.500 FOR DAVIS-STREET QCARTER. Corner at Sixteenth and Yamhill Is Also Secured for Erection of Apartment Honae. Rumor that the 100x100 feet at the northeast corner of Ninth and Darls streets had been sold to the Crane Com pany proves to have been unfounded, as D. B. Mackle yesterday closed a deal for the property from a coterie of Ore gon Trust & Savings Bank people to Clay S. Morse, at a consideration of 137.500. This corner was secured by the syn dicate referred to with the expectation that the city would buy the corner as the site for a new city Jail and emer gency hospital. The plan was aban doned through action of the Council and the syndicate since has held the corner as an investment Mr. Morse purchased the corner for the purpose of erecting on the ground a two-story building with basement for the Baggage & Omnibus Transfer Com pany, which has signed up a lease for ten years. In compliance with its In tention to make good Its part of the lease the company has put up $5000 in advance to secure payment of the rental. Mr. Mackle also negotiated a deal for the northeast corner of Fourth and Co lumbia streets, one block from the City Hall, which Is occupied by six flats, bringing In a revenue of J18T.50 a month. The price was $25,000 and the property nets 8 per cent on the invest ment, as $2q0 will pay taxes and Insur ance. The corner was sold by F- L. Shull of the Portland Flouring Mills Company, to the Fidelity Trust Com pany. Charles Kirshner and Henry Habno have bought the northeast corner of Sixteenth and Yamhill, adjoining the Concordia Club, from two residents of Scotland, Duncan Ferguson and John MacLeod, for $1(,000. There la erected on the ground a frame house, covering 50x100 feet. Mr. Mackle negotiated the deal. It Is announced as the Intention of the new owners to erect a three story brick apartment house as soon as the present lease expires, which will be next June- Will Return Wife-Deserter. SALEM. Gov ernor Chaniberlaln has honored a requi sition from the State of Washington for the extradition of Leslie Oliver, who is wanted at Monticello, Cowlltx County, to answer to a charge of wife desertion.
