If the referendum is invoked ngainst an act of tho legislature which creates a new judicial district composed of two counties c. it of two original judicial districts, which act does not go into effect until May 22, should the peti tions lor such referendum be circulated in the two counties embraced in the proposed new district, in the counties, composing the two districts from which the new district is created, cr in the state at large f And, if a special refer endum election is culled upon such act, would it bo for the entire state or for tha counties embraced in the districts effected f These are two very important ques tions which have been propounded to Secretary of State Olcott, and they ef fect the new ltlth judicial district, "eonp posed of Washington and Tillamook counties, which wan created out of the 5th and 12th districts, by an act of the last legislature, winch act does not go into effect until May 22. Nothing has been found in tho constitution or elociiou luws to cover the points in volved aud Secretary Olcott has sub mitted tho questions to Attorney Gen oral Brown for an opinio1!, The constitution provides that for tho referendum of an act effecting the; stute, district iir county, the petition for same shall contain at least 5 per cent of the legal voters of the state, district or county, as the ease may be. Since the new judicial district has not been Created as yet, it is easy to de cide lhat tho questiuu could not be de cided in the counties of Washington and Tillamook aline, but that it is either one to be determined by the coun ties embraced in the 5th and 12th dis tricts, respectively, from which the new district is formed, or by the state at large, in the estimation of Secretary Olcott, and there it rests. Tha 5th judicial district, from which Washington ei;mty is segregated, is composed of Clackamas, Clatsop, Coluiu ibia mid Washington counties, and the 1 12th district embraces Polk, Tilla mook ami Yamhill counties.
