Tim plaintiff alleges that he married the defendant hon she was a widow with five children and that since the wedding she has treated him in a cruel and inhuman nguincr and finally do cried him. WILL USE BOOKS OF LOCAL ABSTRACT FIB MS IN WOBK Council Unanimously Votes to Hare Special Cleric and Abstract Man Do Work Together. At last evening's meeting of the city council a resolution was unanimously adopted to have Special Clerk Smith co operate with the Salom Abstract com pany in locating the title of property upon which the sewer refunds are claimed.--This check is to be made to awertain foe a certainty who ia en titled to the refund. In oases where there are two or more claimants, the property having changed hands since payment was made or for some other reason, the claims will be held up until the parties have adjusted matters. The resolution passed last evening leaves the matter in the bands of a committee. One hundred claims will be checked, beginning today, to ascer tain approximately the cost of the work, and, if it doos not seem too expensive,the committee will proceed with all possible speed. This means that action will be posisble by Monday evening on a few score claims, at least. It was believed last night that the claims could be checked at the rate of 100 per day, Smith will be assisted in the work by one of the experts employed by the Salem Abstract company. It was the understanding last even ing that the work might be divided between the two local abstract com panies so as to hasten it. City Attorney Explains It. City Attorney Page laat evening ex plained the necessity of knowing ab solutely how the title to the property stood before refunding the money. He believed it to be just as important to know the facts .as in the case of a property transfer. The city waa about to disburse public funds and the fact that a property owner filed an affi davit of ownership was not sufficient. He urged that something be done so that the money might bo disbursed. One plan would be to go tothe county rec ords and ascertain who had title tothe property. This would be a alow and ex pensive way.'' The other atid cheaper way would be to gain access to the books of one or both of the abstract firms and speedily trace title on their books, which arc in convenient form for such work. There was much discussion over the matter, Minton arguing that an arri davit should be sufficient. Date Not Important. The fact that December 12, 1SH2, was mentioned as tne date on wuicn owner ship was important in drawing a re fund was takeu up and Macy contended it had nothing whatever to do with navinent. He insisted that a man s right to a refund was fundamental and no ordinance could deprive him ot it The question whether the man who paid the assessments or the man who owned the tmiportv was entitled to the refund wns discussed. City At torney Page believed the question, with about three others, would probably be litigated. He would like to see the supreme court pass upou a few of the questions involved. Urge Bpoedy Action. Ciimmings urged that something be done without delay to clear up the mat ter. Jones and Spaulding discussed the matter briefly. Spaulding could see no wav out of it but to have the title in vestigated before making payment Abstractor Lee discussed the matter briefly. He said he was not soliciting a job and was present because urged to come bv the city attorney. STATE'S WARDS WILL BE AMONG THOSE PRESENT Capital Journal Carriers, Numbering Two Score, Will Also Enjoy the Festivities of the Evening. "The Band from Amsterdam" drew another packed house at the Grand Opera House laat night despite the fact that old Jupe Pluv was out of humor and had turned his water bucket up sida down. The presentation of the clever sketch was better even than that of Monday night as those taking part felt more certain of themselves and from start to final curtain there was a smoothness that made one think it was professionals rather than amateurs on the stage. The chorus, led by Miss Fleming, was even more attractive and chic than on the first night and it was then almost letter perfect. Otto Von Dippel, who is George C. L. Snyder between plays, seems to stand the long periods of incubation all right and the doctors say he can hatch still one more egg without danger of collapse, which he will do tonight. There is such a demand for still an other presentation, so many not having seen the play or hoard its delightfully catchy music, that the management con cluded to put the amusing musical skit on again tonight. Inadvertonlly in giving mention of the play Tuesday, nothing was said of the part of Beatrice Woodrow a de butante which waa most delicately. por trayed by Miss Grace Lily, who made as sweet and charming a "bud as ever graced a stage or drawing room either. The boys from the state training school will be invited by the manage ment, for this evening's show, and the young folks sure have a pleasont even ing before them. It is seldom they get an opportunity to see anything in the way of theatrical amusements and they will sure appreciate this generous ac tion on the part of the Elks. The curtain goes up at 8:30 and if you nave not yet seen it oe sure ana go tonight for it is the last chance to see the greatest of living incubators. Journal Carriers Quests. Irvine, the defend ant avers that the plaintiffs' allega tion to the effect they were induced to purchase the Elite Cafe through false representations is untrue and that the complaintants were given ample time, and that they did make a thorough in spection of the premises in questien be fore eonsumating the trade. The plain tiffs are suing the defendant to re cover a deed to certain lands in Marion county which they claim were trade to Irvine through false statements mado by the latter. 'W. L. Cochreu, of Holten, Jackson county, Nebraska, who has been in thi city for several weeks looking for a permanent location, stated yesterday that he had divided to move back to his home dace. Mr. Cochron has pur chased a ltiO acre ranch in Jackson county, Nebraska, from J. A. Cooper, of this city, and will return and mak his home there.
