Judge Sea well today made permanent an injunc tion issued in 1908 restraining the Com mercial Pacific Cable company from making a transfer charge on messages filed with the Western Union to be sent to the orient from San Francisco or elsewhere where the two companies are in competition. The Western Union represented the Commercial charged only for exactly what the sender wrote on messages filed at its own offices, but in the case of those who filed through tho Western Union, inserted "via San Fran cisco" and the date of transmission, charge $1 per word for doing it. The executive committee of the Union Pacific rail road decided yesterday afternoon that all Baltimore and Ohio stock, owned by the Union Pacific, must be distrib uted among the holders of common stock as a dividend. It decided to recommend such a distribution and $3 per share in cash to the. company di rectors at its meeting here on Thursday, It the plan is followed, tho activo committee will also recommend that the regular annual dividend be reduced from ten to eight per cent. The Union Pa cific owns $53,607,000 of Baltimore and Ohio common stock and $28,810,000 of its preferred stock.
