Attorney Mc Intyre. acting for Becker, today ar gued that the Indictment against him was Invalid, and had not been proper ly presented. He then Insisted that the attitude of District Attoftiey Whit man, In forcing a trial, while public opinion was at such a high stage, wan illegal. Justice Goff overruled both argument, and dlreyed Mclntyre to enter a plea for hla client The attor ney refused and Justice Goff then In structed the clerk to enter a plea of not guilty. An argument was also precipitated over the trial date. Mclntyre asked for more time, bat tho court refused to listen to him. Finally District Attorney Whitman declared It would be Illegal to start the trial earlier than nine days af'.er the plea was entered. Judge Goff then re-declded to set the trial for Septem ber 12. It was expected that Becker's attorneys would ask for a change of venue to secure further delay. NORTHWEST'S CROPS ARE HURT SOME BY RAINS Portland, Ore., Sept. 3. Crops in the Pacific Northwest today are seri ously damaged by the heavy rains falling almost continuously for many hours. Estimates are that the hop crop In Western Oregon is damaged 15 per cent The wheat crop In sev eral sections of Oregon and Washing ton Is damaged 10 to 15 per cent The oats and barley crops generally are badly hurt The prune crop in Western Oregon is reported In bad conditions ,but this Is premature. RESTRAINING ORDER MADE PERMANENT In a decision rendered today by Judge Galloway he made permanent the temporary restraining order Issued several weeks ago In the case of the American Life & Accident Insurance company, of Portland. This suit was commenced by the Insurance company to restrain the Inurance commissioner from revoking the license of the com pany. An examination naa Deen maae In February of Its assets and finding them unsatisfactory the commissioner suspended the license of the company and gave It a certain time In which to make good. Failing to do so he gave it additional lime and declared that unless It made good within It he would revoke the license. The company then instituted Injunction proceedings, maintaining that It had complied with all of the Insurance laws of the state and that Its assets were of a character required by the Insurance laws. Insurance Commissioner Ferguson says an appeal will be prosecuted to tha supreme court of the state, and as the case is In the nature of a test of the Insurance laws of the state much Interest Is being attached to It. THIRD PARTY HAS NO TICKET IN NEBRASKA Lincoln, Neb., Sept 3. No third ! party ticket will appear in Nebraska, according to a definite statement Is sued before the opening of the pro gressive state convention here today. ! All but two of the presidential elect ors are for Roosevelt The conven tion will only adopt a platform, name ' the two men to oppose the two Taft electors, and then endorse the re mainder of the Republican ticket.
