Aug. 13. Deploring the fact that Clar
ence S. Darrow ever came to trial at
all, Horace Appel, associate counsel
for the defense In the Darrow bribery
trial, today opened the defense's argu
ment to the jury.
"What a shame It 1b," began Appel,
"that Clarence Darrow. whose name
Is Inscribed In the heart of every la
boring ninn In the country, should,
when he has reached the highlands
of life and Is now on bis pathway to
the lowlands, be pointed at as a per
jurer and a criminal!
"What a shame It Is that he, because
the prosecution can point at him and
say 'that looks suspicious' and 'this
looks suspicious,' Bhould risk go'ng
down the road to the dark penitentiary
to a grave with a headstone Inscribed
'He died In disgrace.'
"Can you convict on suspicion only?
No. You cannot convict this man un
less you can put your hand on your
heart and ask your souls, 'Is he
guilty',"
Speaking of Detective Bert Franklin
Appel declared: "You must view the
testimony of an accomplice with sus
picion, because an accomplice Is a
convicted felon. In the eyes of God
and man. when he goes on the wit
ness stand."
His voice breaking with emotion.
Appel appealed to the Jurors: "Judnt

are you to convict Darrow? If Dar

Appel mopped his brow and said, In
a low tone of disgust:
''Yet we have seen his testimony
admitted here to prejudice you against
this defendant."
Shaking a volume of evidence In the
faces "of the jurors, Appel announced
that he would tear down Ford's argu
ment by reading the testimony cited
by the prosecutor yesterday, which he
said had been misstated.

That the United States will take an
active hand In suppressing the Nlcar
aguan Insurrection was indicated to
day when 300 more American marines
were landed at Managua, the capital
of Nicaragua, bombarded yesterday by
rebel troops. Several women and chil
dren were injured by bullets and
bursting shells.
With the reinforcements provided
today, It Is believed that Commander
Terhune, of the American forces, will
have sufficient men to prevent further
attacks, which have Imperiled Ameri
can lives and property.
Although a proclamation was Issued
by the government warning the peo
ple to leave Managua, It Is believed
the arrival lof additional Amerlcon
marines will restore quiet so far as
the capital is concerned. The Nlcar
aguan government is said to be de
pending on the support of the United
Slates.

WOOL DILL
OVER VETO
Washington Aug. 13. By grace of a
ruling made by Speaker Clark, the
house today passed the wool tariff re
vision bill over President Taft's veto
by a vote of 174 to 80. Nineteen Re
publican Insurgents voted with the
Democratls.
On the vote as first announced by
the Bpeaker the Democratic-Insurgent
alliance apparently bad failed to pass
the bill by two votes. Ten members
who had paired with absentees voted
as present.
Clark ruled that It took only two
thirds of the members voting "aya"
or "no" to pass tho bill, and ruled that
tv.o-thlrds had so voted "aye" and
that the bill was passed.
A violent dispute followed, the Re
publicans bitterly attacking Clark. On
this I'nderwood made a point of order,
thus enabling the speaker to declare
the bill passed.
Before the vote was taken Cannon,
of Illinois, Hill, of Connecticut, Green
of Iowa, nnd Utter of Rhode Island,
defended President Taft's veto of tho
wool bill.
Utter nceused the Democrats of
plnylng politics in foisting rcsponsl
blllty for the wool bill on the presi
dent. Fitzgerald of New York took a hand
in the debate and called the wool re
port of the tariff board mere guess
work. Heflln, of Alabama, also Bpoke

from Glendnlo, Or., says that Itov. J
8. Howard, a wealthy resident of
Southern Oregon, while on a hunting
trip twenty miles south of that place
was Bhot and probably fatally wound
ed Tuesday morning.
The meagre details did not say whe
ther Howard was accidentally shot by
a member of his party or not

news of the husband and father's
death, Mrs. Townsend having Just re
ceived a letter from her husband, who
was well and wns expecting to make
a visit to the family within a short
time.
As the campaign waxes hotter many
