Warden Curtis Quarantined- Two sons of Warden Curtis are suffering from scarlet fever, and, as a result, the- warden and his family are quarantined In tholr homo. SUPREME COURT HANDS DOWN SEVEN OPINIONS Asserting that the plaintiff had been guilty of contributory negli gence, the supreme court this morn ing affirmed Judge Burnett In a de cision made while sitting on the bench of the circuit court for this county, in the case of the S. J. Bur roughs against the Curtis Lumber company, an action brought to re cover in damages for injuries sus tained while employed in the com pany's saw mill. Burroughs occupied the position of oiler with the company and one day while oiling the feeders his clothing caught in a rapidly revolving shaft with the result that he sustained ser ious and permanent injuries. He commenced a suit against the com pany alleging that It had negligently failed to keep Us machinery In a shape and aBked for damages. The company maintained that he had vio lated instructions In oiling the ma chinery while It was running and that he was guilty of contributory negligence and, therefore, not en titled to a judgment Other Decisions Rendered. COLLELGE OK ORATORY 1CKLTTAL TONIGHT The College of Oratory of Willam ette University will give a recital to night la the University chapel. Mrs Savage, dean of the college, has been working hard with her pupils in prep aration for this, and thefre promises to be an Interesting program. The recitals of the College ot Oratory are generally more brfef than those of the College of Music, but every number Is Interesting, and the chapel should be crowded to the doors to. night. Miss Vandervort, Miss Erlx- an, Miss Klein, and Mis Laubridge will be among those who will give readings. Miss Irma Shumway will sing and Miss Turner will play. Dr. Sweetland has commenced work on the thr new tennis courts which are to be placed on the Wil lamette campus. Two will be placed near the gymnasium for the use of the young men, and the other Is be ing leveled near Lausane hall for the benefit of the girls. These courts will add a great deal to the enjoyment of the students, and the looks of the campus. Willamette Is progressing rapidly in the student enterprises and the movement is going to make the old school one of the best In the North west, as far as athletics are con cerned, and also the spirit will tend to greatly increase the registra tion. CA0K (II H MAY M ILD CLUB HOUSE The election of officers and the dis cussion of plans having for their ob ject the erection of a club house on the banks of the Willamette river were the important features of a meeting held last evening by the Sa lem Canoe club. The plans as outlined call for the construction of a model structure and the prospects for them being carried into execution now look bright. Just where it will be located is a matter yet to be decided, but It la desired If possible, to lease some land near the Salem Flouring Mills and It will probably be located near there. Powell, the man whom the police believe was murdered near Fort Ross. Powell's body was brought here this afternoon. Investigation showed that death was due to bullet wounds In the head and body. LOCATION OF ARMORY NOT DECIDED Oil The statement In the Capital Jour nal Monday to the effect that an ar mory site was agreed upon at the cor ner of Ferry and Liberty streets was upon authority of Carl Abrams, a gen tleman who was Instrumental in get ting the Increased appropriations for military purposes, and has charge lo cally of the matter of an armory site According to the Statesman today, which he Is also iwnnected with, the site chosen Is on Court and Cottage streetB, and not on Liberty and Ferry. The owners of the property on Court and Cottage streets are Charles L. McNary and Geo. F. Rodgers, and they knew nothing of that property being chosen, for the site of the ar mory. When The Capital Journal makes a statement it is usually on good authority, and It supposed it had such authority for its statement Monday. BOARD OF TRADE AGAINST RECALL The Salem board of trade last night passed the following resolution: Resolved, by the Salem Board of Trade executive, committee, that the attempt to invoke the referendum against the appropriations for the state university and the state agricul tural college and other state Institu tlons Is not in the interest of the de velopment of the state at large, and that every citizen should be discour aged In the matter of signing these petitions and promulgating the same. NEW TOWN LOCATKD OX THE O. E. EXTENSION What Is considered as a move for an Oregon Electrlo townslte on the nww extension south is seen In the purchase today of 120 acres of land at Hall's ferry, about nine miles up the Willametet river from Salem The purchase was made from H. J Spitzbart by E. M. Crolsan.and the consideration Is said to be $9000. Mr. Crolsan has been purchasing land freely in the Interest of the Ore gon Electric for right-of-way pur poses, and it Is rumored that buy was made for the Oregon Electric. CAME ON FIRST TRAIN AND IS FIRST IN SALEM Horace. D. Smith' who arrived) in Salem from Osage, Iowa, Just a week ago, has decided to, settle in the city, and has purchased the Simpson cor ner at Eighteenth and State streets, and Intends to build on the lota some residences, and probably also a store building.' Mr. Smith left Iowa on the first qolonlst traJn coming west March 10, with Oregon as his destination. Upon arriving In Salem he became so pleased with it and impressed with its future that he decided to look no farther, but to settle. Menzles and wife, of Portland, are Salem visitors and are staying at the Cottage Hotel. C. A. Peterson, representing the Moneywelght Scale company, of Portland, is spending part of the day In Salem, and will visit towns on the West Side before returning to Port land. CLAIMS SHE WAS FORCED TO SIGN DEED Alleging that her husband, with forca of arms, imprisoned her in their dwelling house and intimidated her into signing a deed conveying certain property which she held In fee simple, Isabel a Steel today com. menced an action in the circuit court against W. J. Steel wherein she asks that the deed be declared null and void. They have been married, she says In her complaint, for a period of 10 years, and that it was on the first of March' of this year that he Im prisoned her In their dwelling house. Fearing that bodily harm might re sult, and that the Imprisonment would continue, she says she signed the deed. The parties live near Buena Vista. MOST MEXICAN REBELS SEEM TO BE CAMPED El Paso, Tex., March 21. Seven thousand rebels are encamped In the states of Teplc, Sonora and Slnaloa, according to a newspaper correspon dent who returned here today from a tour of the three states. Few Amer icans, he said, were among the sol diers, the troops being made up al most entirely of natives. Notice to Contractors.
