Why Is an Express Company?"
Law la merely an expression of the
popular will, and if the popular will
Is not behind the law, or does not
stay behind it, that law should not
exist. And if you and I and all of
us do not want a law enforced, who
is going to enforce It? .
Here is Section 181, Revised Stat
utes of the United States, passed
March 4, 1909. At that time there
had already been In existence for 40
years and more a law covering the
same point For 40 years and more
the express business of this countrv
had been operated In direct violation
of the older . statute. There is no
question about it In so far as the
express companies compete with the
postoffice department In can-Tina-
mailable matter and that is no
mean share of the express business
they are breaking this law.
"Whoever shall establish any pri
vate express for the conveyance of
letters or packets, or in any manner
cause or provide for the conveyance
of the same by regular trips or at
stated periods over any post route
which is or may be established by
law or from any city, town or place
to any other city, town or place be
tween which the mall Is regularly
carried, or whoever shall aid or as
sist therein, shall be fined not more
that $500 or . Imprisoned not more
that six months, or both.
'Provided, that nothing contained
In this section shall be construed as
prohibiting any person from receiv
ing and delivering to the nearest
postoffice, postal car or other author
ized depository for mall matter any
mall matter properly stamped."
You may wonder why the law has
not been enforced agalnBt the ex
press companies. Not long ago the
United States circuit court dismissed
a suit brought under this law by Na
than B. Williams, of Fayetteville. Ar
kansas, on the ground that a private
citizen had no right to bring suit
against the express companies for
operating against the law over the
post roads; such suit, said the court,
could be brought only by the govern
ment.
Thereupon, P. R. Howard, of Cin
cinnati, brought pressure on the at
torney general to act against the ex
press companies. The answer was
the following statement, and issued
by the department of Justice:
"The department has made a very
complete study ot the proposition and
agrees with Mr. Williams on the law,
except as to the one point, namely,
that there has been an administra
tive construction against the propo
sition for over 40 years, and the
chances are that a -suit will be de
feated on that ground."
Our government, ignoring the new
er statute, takes the position of klll-
by "administrative construction,"
what is supposed to be the popular
will.
