J After being married for almost ft quarter of a century lacking one year and having reared a family, Mrs. Margaret Hoffman concluded that It was wiser and better for her self and children, and, of course al so tho husband, that she "secure a divorce, and made her appearance before Judge Galloway yesterday af ternoon for that purposes. Tho husband, H. L. Hoffman, had evidently anticipated her In this con clusion as he preceded her In filing n complaint which charged. cruel and Inhuman treatment. But anticipa tion was tho extent In which ho was permitted to Indulge In that luxur ious idea as the wife came back with an answer in which, to use legal phraseology, sho admitted, denied . and affirmed. Now there was not much to' admit there never Is in an answer, 'but it was ventured to admit that they were husband and wife, and then came a long string of denials. In legal language she denied that she had ever treated the husband In a cruel and inhuman manner as speci fically alleged in the complaint de nied that she had cruelly and inhumanly- treated him at any other time or at all. When a man finds h's wife's language reduced to that kind of language, It is enough to make any husband beat a hasty re treat, and 'the husband in this caso did failed to appear. Everybody Worked Rut Father. Tho wife testified that the hus band did not relish the. responsibility of having a family to support, and that ho would not contribute to their support. 'According to her evidence ho feigned sickness when at home, but whenever ho worked for some one elso he was a first class man- so his employers had told her. Two daughters came to the stand and tes tified along the same line. The mother was industrious, they testi fied, but tho father wasn't, though ono did finally testify that he clerked In the mother's store, but then maybe this wasn't work,. Tak ing it all around it seemed ' like ,1 caso where as the song goes, "every worked but father." Wouldn't Conio Back. In addition to denying the hus band's charges tho wife in a cross complaint asked for a divorce on the ground of desertion and the abovo evidence was Introduced In corroba tion of it. The father left home, it seems, something over a year ago. He did not have any causo for leav ing of course not. Tho wife testi fied she had always treated him in tho kindliest manner and so did the daughters. There was a welcome for him at the homo whenever he de sired to return, and thoy had exert ed every possible effort to effect his return, but ho wouldn't .come back, and hence the divorce proceedings and it wns granted. Caso Too Complex. Judge Galloway yesterday after noon rendered a decision In the caso of F. A. Schulblnger against Anton and Lois Im'per, This action was brought . to bring a settlement among the partners, in a cheese fac tory at Silverton, and was known as the famous cheese factory case. A wholo day was consumed In Its trial, and a mass of evidence was intro duced. The system of' bookkeeping was unique -in Uiat it could not b9 understood by anyone not conver sant with it, nor could they be taught to understand it, and was such that tho parties using it after a month or so could not understand cry explain It. Tho money when taken. In was marked down on the book. If deposited in tho bank tho figures wore underscored In a cer tain way, and If something else was done with It another underscoring was used with the result that as time passed by, tho underscoring became mixed or forgotten or it could not be remembered who did the work. The attorneys Martin for the plain tiff and Inmann for tho defendants, admitted that' thoy were unable to arguo the case, and therefore sub mitted it without argument. The couj;t admitted that he was unable to' solve it unless the attorneys could throw some enlightment on It, and they could not, and It was dismissed without cost to either party.
