McBrldo In tho case of Richard Wills vs. tho Ne halem Coal company was reversed In an opinion by Cominlsisoner Slate, today. This case was appealed from Clatsop county and Involves a num ber of Interesting legal points In the law of corporations. The action was brought by the complainants against the company and Mrs, M. S, Cope land, promoter, to compel the latter to disgorge certain properties in the corporation which It was alleged had been acquired by Illegal means. The case of Louis Sommers et al vs. Charles A, Compton, which is a case Involving title to property, was reversed by Justice Eakln. The case was appealed from the ruling of Judge William Smith, circuit judge In tho county of Baker. Marlon County Probate. E. T. Barnes has been appointed administrator for tho estate of Mary L. Emmltt, deceased. W. W. Talt, T. Harper and George Landor, apralsers of the estate of Lottie Mc Keo, an Insane person, have filed their report, showing that the estate contains $1000 worth of real and $1124 worth of personal property. M. E. Pogue will argue the divorce of Parish vs. Parhh In tho supreme court tomorrow. Minnie Hottlnger hns been apt polnted administratrix for tho estate of A, Hottlnger, who died In Canada last year. The estate In Marlon county consists of $3000 worth of personal property. On. petition of J. s. Penebaker, guardian of Sarah J, Watt, an Insane With practically no opposition on the part of those who heretofore have bean adverse to the extension of further franchises to the Oregon Electric Railway company, tho coun cil last night reconsidered Its nctlon on tho franchise voted at tho meeting last Monday, Btruck cat tho penalty and forfeiture clnuso from the fran chise, substituted for it a clauso favorable to tho company, and pass ed tho amended franchise with but one dlscentlng vote. The nctlon of the .council last night evidenced a remarkable chango of attitude, scarcely any discussion following the amendments which wero Introduced and voted upon. Hardly had the meeting been called to order when a motion to reconsider tho vote of last Monday wa3 unani mously carried. After tho transac tion of some minor business Coun cilman Stoltz took up tho matter of the Oregon Electric Rnllwny com pany's franchise, the voto on which had been reconsidered enrly In tho evening. Ho moved that tho council resolve Itself Into a commltteo of tho whole, which wns carried, Councilman Eldrldgo moved that the last part or Bectlon 8 and tho wholo of section 0, relating to tho pennlty for tho violating of tho frnn chlso be stricken out. Ho then of. fered an amendment to tnko tho placo of section 9. The new section readB as follews: "Tho city council shall reservo the right nt any time to compel tho company to fulfill the provisions of thU franchho." Grqenbaum offered tho following amendment: "Tho city reserves tho right to fix by ordinance tho penalties for violation of any of tho provisions of tho franchise." Eldrldgo amended this by substi tuting tho word "fines" for ponal tles. Grcenbaum consented .to this, and this nmondment was carlred. Attorney Jphn C. McNary nddrcsf ed tho council on tho subject,. He said. "I had hoped that this matter was settled at the last meeting, but managor Talbot informs mo that the company cannot accept tho frnnchlse with this pennlty clauie in It. It is into regnruing tins company as a criminal, and suspecting It of not fulfilling Its part of tho franchise. Tho financiers of the company say that with n ..forfeiture claiiBO In tho franchise, they cannot accept It. "The forfelturs clause is not c business proposition. To ask this company to accept a franchise where by tho owners are obliged to sur render their property absolutely If for any reason within the next 20 years one of tho employes should leave a car on the tracks longor than half an hour In unjust. You would n't ask any business man to accept such a proposition. With such n clause in the franchise the company cannot sell their stock. I didn't un derstand" the situation when I con sented to thh clause last week. But I understand It now, and I hope you will understand it in the samo woy." A voto was then 'taken on El drldge's original amendment, and It was carried. The franchise as It now stands contains no penalty clause. The bill was then read tho third time and passed. Rleyclo Ordinance, The committee on ordinances rec ommended that the bicycle ordinance referred to U be not passed, but sub' mltte'l an nmendment under which bicycles riding on sidewalks should be prohibited on the south side of all streets running east and west, and on the west side of all streets run ning north and south, except on the portion o'f Court street between Church and Twelfth street and on Church street between Mill and Mission street. It also made un lawful the riding of bicycles In any public park and on .the sidewalks of any paved street. Tho report of tho committee was adopted and the amended bill was carried to the third reading and passed, Other Proceedings.
