Horo Sam Koser waa the subject ot a further consurlng at tho hands of Judgo Galloway, who stated: "Thl assistant 4o Secretary Den son, Mr. Koser, who evaded giving tho truth, and whole truth, aa ho awore to do. will also be brought back to the wltnss stand, and made to answer straightforwardly." "I look upon it Is a fraud and n Jok( absolutely nothing to It made for political purposes and pros ecuted for political purposes," Inter posed Fulton. "Tho court has hold that this is a serious caso." "I havo had and still onturtain tho moHt profound respect foFtho court, and for the opinion of the court, but I hnvo no respect for tho causo of action," replied Fulton. "But for your honor, and for your honor's opinion, I think tho court will Justify me when I say I have Ihe utmost re spect for It, and I do not bellovo thnt In Oregon there la, a more upright, Judicious officer. Dut I can sny that tho causo of action was conceived In Iniquity and brought forth In frnud; I can say it was concocted in noino back chamber and brought hero for political purpooe8. If theso people had wanted Mr. Dunbar hero they could havo sent for him, or If thoy had requested that I produco Dunbar ho would havo been hero. Wo havo not run away from this case, we havo nothing to hldo, nnd fool that wo aro perfectly capablo of taking caro of our own caso." After Mr. Fulton left the stand the court snld: "Cortalnly your testimony Is very candid, and thoro can bo no fault at tached to counsel for not producing those memorandum books, which, so far ns you know, ho has destroyed. Thoso memorandum books woro kept during all of this time, and tho fault, If any, lies with tho defendant; and tho court Is cortalnly of tho opinion that this order should bo granted, and wants to Assuro counsel for tho plaintiff that all tho powers of tho court will bo exerted, no mattor to what extont, to bring thoso books In to corart, or placo upon tho record Intelligently tho contents of thoso books. It Is tho firm belief of tho court thnt It Is tho duty of tho court, and It will enforce all tho powors at Its command, and .It will grant tin ordor now." "Thon tho court finds that tho books arc In his posesssion as against our affidavit?" asked Fulton. "Unloas tho counsel for tho defend ant saw thoso books destroyed it Is only an opinion, which comes socon hand from tho defondant. Mr. Dun bar was not under oath whon he told counsel, and tho court does not know whether thoso booka were de stroyed or not. Tho court does not doubt but whnt tho counsol believes that tho books wore destroyed, but tho court has gravo doubts that tho books woro dostroyed. Tho court. from Ita personal acquaintance, thinks Mr. Dunbar Is too Intelligent a man to destroy such books as thnt, and tho court will bo pained to know that ho would take thoso steps to cover up transactions In a public of flco." Postponed Till Afternoon, Tho Dunbar case was resumed this afternoon at 1 o'clock, Instead of at 9 o'clock this morning, owing f tho Inability of Attorney Fulton t return from Portland with the affi davit of Dunbar. This affidavit waj filed with tho court this afternoon, and consisted of about tho same &ub stanco as that contained In tho ono filed by Fulton yesterday, In which It was claimed that the fee record books had been destroyed. The continuance of the case until this afternoon was decided upon at a ohance meeting of Judgo Galloway and Fulton In Portland last night, both of whom thought they would not be able to return In time for the morning session. Judge Galloway, howover. went to a Democratic meet Ing at Oregon City, and returned with Governor Chamberlain and others at 2 o'clock this morulng.
