CLASH OVER PAT CALHOUN San Francisco, nn. 28. In an ef fort to force the prosecution to place Patrick Calhoun on trial immediate ly Attorney A. A. Moore, represent ing the indicted trolley magnate this morning indulged in a scathing denunciation of district Attorney Langdon. He referred to the indict ment ngalnst Ruef as being fraudu lent, declaring that tho coming trial of Ruef was merely a club which tho prosecution would attempt to u pq upon Calhoun, nnd accused district nttorney with breaking fnith in regard to the Calhoun trial. Whon Langdon replied Moore dared him to set a date for Calhoun's trial. Moore asserted that tho trial of Calhoun had already begun and had merely been continued nt the request of tho prosecution because the state feared that the most Important wit ness had left the fold. During Moore's lengthy diatribe, Langdon's fnce became flushed with anger, but only twlro did he reply, once to deny tho motive nBslgned to the prosecu tion having on indictment returned against Ruef, which they never in tended to prosecute, and, secondly, to state that tho prosecution would refuse to enter Into any stipulation In regard to the trial of Calhoun. Attorney Kenn opened the pro ceedings by making a plea for a con tinuance in bchnlf of Ruef. He said ho had made every posslblo effort to secure an nssocintc counsel to assist Mr. Ach, but failed. District Attorney Langdon replied that 'ho was very desirous of having the trial of Ruef proceed as soon as possible, nnd nsked that a date plionld now be set whon tho ense could definitely proceed. Judge Lnwlor then continued the mattr until Thursday morning, wh'ii Henry Ach will be prosont. The t'nlted Railroad cases were npxt called, nnd no sooner had 4ho name of Calhoun been mentioned when Attorney A. A. Moore nroso nnd started to protest against the ac tion of the stnte. Tho defendant, Calhoun, is pres ent in person nnd answers ready. I would like to sny to your honor that wt want now to go ahead with his trial 1 notice In a dally Journal that the district attorney has de clared that Calhoun was attempting to seek delay, nnd .tho prosecution hns decided to bring Ruef upon tho stand. This stntemont, as everyone wlm t familiar with the caso. knows, bcnrB n oresemblanco to tho truth. Thw Indictments wero returned In May, and. after tho preliminary mo tions had been disposed, Mr. Calhoun pleaded not guilty In August. Tho trial was actually sot. Wo woro rudv and Mr. Calhoun was prosont. At the request of tho prosecution It wns continued until December 9." 'The district nttorney never stipu lated Whon any ense wns to be trlod, and never will. We nnnounco that we will proceed with the caso of Ruef Tho district nttorney IntondB to uso his own dlscrouon," ropneu Langdon. STANFOllD WANTS CANTEEN.
