Miller described how he had enter ed into the conspiracy .wih Kincart, how they had agreed upon a cou'ie, concocted the bogus "Kmmettsburg of Xcw Zealand Company,'' and started out to inveigle the unsuspecting out of their money. He went further and drew Charles Nickell into tho 6Chemt) and told how the latter, after tho first bunch had emptied their pocketbooks Into the conspirators' coffers, slapped him on tho back nnd frlicited him on tho fact that he had gone- about it in tho right way. Then came the entrance of Martin W. Hogo into the scheme, with the details of how he became the legal ad viser of the Mo and later became a hustler foi victims at so much each in vestment, and so zealouly lid he en- tr into the spirit of the thing that miles of the timber, he was made a special proposition whereby ho was to receive $5 apiece for victims as soon as tbey applied and $10 on final proof. Alien Irwin and 6live Majors. Williams came to see him first and said he had- been appointed a commit tee of one to look into the proportion. He wanted to know the names of some ot the head men of the eompany and was finally given the fictitious name of J. D. Wtf-on, of Minneapolis Minn. Williams was satisfied and said he would get about six members of his own family. The namo of the "head man" was to go no farther than Williams, for Miller said he was not supposed to tell who was in the company. Hoge was so successful that he was offered ?i" for each one he gof as soon as Mil ler got his fee of $23 and $10 mortJ on final proof. Then others were en gaged to rule, among them David Ir win, a cousin of the o'her Irwin, and Solomon Lander. Hoge did a good business and was paid in all about $100. He aettd as the legal adviser and quieted the feats of some of the timid ones, who wanted to be shown. Then Luckenbach suspected some thing and told Miller his scheme was a fake and that tho company was a bogus one. He was let in on tho plot and infermed: by Miller that in the nbsenco of Kincart, who was then away, he might take his place and sha-e the spoils. The new man hust led hard and added several more vic tims. Miller was still on the Etand when the court adjouKned at noon. Justf before the tTial opened yester day afternoon, F'ltnk E. Kincart, one of the defendant, changed his plea o guilty. This was a severe jolt to the defense, coming as it did immed iately befose Henry W. Miller was 'o up-eient that his company wanted o buy Southern Oregon timber Innd. He confessed that there was no such company and that all they expected to get was the locators' fee. Con tracts -to be signed up between the company and tho sucker were ar ranged. Then they looked! tho field ove for suckers as Miller frankly stvled their intended victims.
