Ho alleges: "That at Salem, Oregon, on or about tho 4th day of April, 1003, tho plain tilt paid to the defendant tho sum of two hundred and eovonty dollars, the samo being tho $270 mentioned in plaintiff's complaint, and it was then agreod botwoon plaintiff and tho do fondant that thev should bn married, and that tho defendant and tho plain tiff would then go over to tho stnto of Washington, whoro tho plaintiff owned certain lots, and that, for tho said sum of $270 paid him as aforesaid by tho plaintiff, tho dofendant would plan and superintend the construction of a double houso upon tho said Iota of tho plaintiff for her, and that tho said work so agreed to bo performed by tho do fendant Bhould be in full, and complete satisfaction and paymont of tho said $270, and that the defendant has over ninco been and Is now ready, able and willing to perform his part of the said agreement, but tho plaintiff has failed nnd rofuscd to allow the defendant to perform his part of tho said agree ment. "That during the year 1003 tho plaintiff and the defendant entered Into' a mutual agreement whereby they each promised and agreed to marry tho oth er, nnd becomo husband and wifo.
