It applies only to those modeled after the Backhaus agree ment, which has been declared to be unilateral, lacking a mutuality of in terests, and Is hence not binding on both parties, and Is non-enforceable. The effect of the decision will be to require dealers that have been using that form of contract to reconstruct their blanks, to the extent that It will stand a legal test There are several forms of conracts In use In this state, and the decision does not reach a great many, for the reason that they comply with all legal requirements In that they are binding on both parties, and can be onforced. Clerk Not Liable For Goods Sold Minor Brother Tho case of Paul Vandorsol vs. Thp Oregon Shoe Company was heard In Justice Horgan's department Monday afternoon, and was submitted to the Jury at 6 o'clock. The real question Involved was whether or not a salesman Is responsi ble for the sale under verbal arfange- mont of goods made to a minor broth-' er. When the plaintiff In the case die- continued working for the dofendant company, there was owing the house ; from a minor brother of the plaintiff the sum of C for a pair of shoes that the plaintiff had Mid. ' The manage- ment of the firm proivosed In settling with Paul Vandereol to deduct from the amount of wages that was duo him the sum of $6, that was due from Wil- Ho, a brothor of the plaintiff, but the ox-cldrk refused to settle on such torms, and, an ngreoment not being roached, the case was carried Into the courts with Uio result given above. Counsel further de clared that there was not a law on earth that would make Yandersol ' le gally obligated to pay a bill for his, minor brothor, for there must bo ft contract In writing to enforce such a transaction. The attorney concluded his argument by puylng a deserved compliment to the young man, Willie Vandorsol, whom he represented as being the mainstay uud supiiort of a mothor, and who had always shown himself In his dally walk to he a young man of the strictest Integrity and un assailable honesty. The Jury consisted of Messrs. David Stidner. J. P. Farley. II. S. llelle. N. II. llurloy. B. T. Albert and J. V. noggs. A verdict was returned for the plain tiff for tIO.10, being the amount sued for. Fruit Tracts Dedicated The Smith's Fruit Farms were ded icated aud opened to settlement today. The laud dedlcuted consists of 171 acres, divided into tracts of five and six acre. The farms nre located south and east of the Hural cemetery, an the Salsm-Jerterson road, and Itetweeu the southern extensions of the Commercial-street and Mornlnsjdde street rail way lines. There Is nD clue to the perpetrator of the deed, The only description Mr. Canos can give of his assailant Is that he was a man of average sise. Mr. Canos is of the opinion, however, that the footpad t none other than a local character, wno Was acquainted with the habits 0f himself, When seen today. Mr. Canos stated that he was still feeling sore from the imiise he had received at the hands 0f his unexpected assailant.
