Witness went to cash check, and was Informed that Smith had no money In bank, having drawn It all out of bank by check on previous day. Met Smith same day and defendant claimed that he would have money from the East in a few days, and wanted witness to wait a few days for his money. Gave Smith money entirely on representa tions that he had an abundance of money In the bank. Gave Smith mon ey on checks in M gold pieces. Did not see Smith spend but a sne.l! amount of money. On cross-examination by Ford, wit ness said check was given about 6 o'clock In the evening. HatT loaned the defendant money before, and was paid back. Ford asked what was tha nature of the transactions between Smith and Hodgklns and oUior parties. State objected to any question touch ing on gambling, because of alleged Ir relevancy of fact to the crime that was charged. Slater for defense said it was perfectly right for defendant to show all transactions attending tho loaning of the money. After some wrangling between coun sel. Justice Horgan sustained the ob jection, and Ford continued Uie cross examination, bringing out the fart that Hodglna knew after he loaned Smith the first ?I6 that the man was playing th. game of "21." The third time Smith asked for money, he tobl witness that he was playing the game, and wanted to get even with the game. State objected to nil questions per taining to gambling, and court sus tained the objections. Witness admitted that he had seen gam., running In Stutosman's cigar tore, but did not think there was nny game, lietng conducted there at the Um. he loaned Smith the money.
