Tho information charges Markloy with murdor commit ted on Juno 2Gth, when ho "folonious ly, purposely nnd of deliborato and premeditated malice, kill said J. D. Fain, by then nnd thorc unlawfully, folonlously and purposoly shooting tho said J. D. Fain with a flroarnf, to wit: a shotgun." Coroner's Jury Accuses Markley. Coroner D. P. Lane nnd Deputy Prosecuting Attorney John II, Mc Nary conducted an Inquest over Pain's remains Wednesday nftomoon. A Jury was empaneled, consisting of J. E. Eldridgo, 13. A. Vaudnmmo, W. R. Mc Kay. Patrick Oeelan, Q. A. Eborhard, and A. V. Buyoorio. After hearing tho testimony of a dozon witnesses, tho Jury returned a verdict finding that Fain enmo to his death from a gunshot wound at tho hands of John P. Mnrk loy. Tho testimony at tho Inquest showed that Mnrkloy had threatened Pain's life, that Fain, in going to his barn, was obliged to pass through an en closure at tho rear of Markley's store building, that ho was shot to a reason able certainty by Markloy from tho back door ot tho storo, as smoko was seen passing nwny in tho nlr from tho doorway immodlatoly aftor tho report of tho gun.
