SCHLEY TURNED DOWN
BY THE PRESIDENT
Court of Inquiry Decision Stands-Roosevelt Says it Was a
''Captain's Fight.

today made public tlio statement on Ad
miral Schley's appeal and tho anawor
thereto, from tho Navy Department.
The President says: "I bavo examined
both with utmost enro, ao woll aB the
preceding aj)pcal to tho Secretary of tho
Navy. I have read through all tho testi
mony taken before tho court and tho
statements of counsel for Admiral Samp
son and Admiral Schloy ; hove examined
all the ofllrial reports of every kind In
referanco to tho Santiago naval campaign
and also personally had boforo mo the
four surviving captains from tho five
ships, asldo from thoso of tho two Ad
mirals, which wero actively engaged at
Santiago. It appears that tho Court of
Inquiry was unanimous in its findings
of fact, and unanimous In its expressions
of opinion and most of its findings of fact.
No appeal is mado to mo from the vor
diet of the court on those points, whoro
it was unanimous, I have,bowever, gone
carefully over tho evldonco on those
points also. I am satisfied that vi the
whole, the court did substantial justice

demned tho failure to onforco nn eill
clent night blockado at Santiago while
Admiral Schley was in command. On
tho other band I fool that there is a
reasonablo doubt whether he did not
move bis squadron with BufDclentex
psditlon from port to port. The court
la united in condemning Admiral Schley 's
action on tho point whoro it steins to
mo be most gravely orrod his
"retrograde movoment," wbon he
abandoned tho blockado, and his dis
obedience of ordors and mis-statement
of tacts in relation thoroto. It should
be remembered, however, that tho ma
jority of these actions which the court
censuros occurred flvowooke or inoro bo
foro tho fight itsolf and It cortalnly
sooms that if Admiral Schley's actions
wero censurable, bo should not havo
boen loft as second in command uudor
Admiral Sampson. Ufa offenses wero
in effect condoned when ho was not
callod to account for thorn. Admiral
HAmpBon, after tho fight, in an official
letter to tho Navy Department alluded
for tho first time to Admiral Schloy'a
"roprehensiblo conduct" six weeks pre
viously. If Admiral Schloy was guilty
of roprohontlblo conduct of tho kind
which called for such notice by Admiral
Sampson, then Admiral Sampson ought
not to bavo left him as senior ofllcor of
the blockading squardon on tho third
of July, whon ho (Sampson) steamed
away on Ills proper errand of com
munication with Qunoral Shatter.
"We can thoioforo, for our present
purposos, dismiss the consideration of so
much of tho appeal as relates to any
thing oxcopt the battle, As rogurds this
tho point raised In tho appeal isfeutweon
Admirals Sampson and Schloy, as to
which was in command; as to which was
entitled to tho credit, if olthor of them
was roally entitled to any unusual and
pro-eminent credit by any spoolul ex
hibit of gonlus, skill, and courage. The
court could havo considered both of
those questions, but as a matter 6f fact
it unanimously oxoliidod tho evidence
offered upon thorn, ami through its pro
announced refusal to hear Admiral
Bampbon'a aldo at all, and in view o(
such exclusion, tho majority of the
court acted with entiru propriety in not
fcxpreoilng any opinion on this point.
"Tho tnattor has, however, boon
raised by tho President of the court.
Moreover, it is a point upon which Ad
miral Sohloy In bis appeal lays the most
stress, and which ho especially asks mo
to consider, Tho appeal of Admiral
Schley to mo is not as to this. The
chief jolnt ho raises really Is an appeal
from tho decision of tho Court ot In
quiry. "Fire-sixths of tho appwal Is devoted
to this question of command and credit;
that is, to a matter which tiio Court of
Inquiry did not consider. It Is In effect
an appeal from the action of President
MoKluloy throe years ago, when he sent
in his recommendations for promotion
for the various olllaem connected with
the Santiago squadron, basing those reo
ommondatious upo i his estimate of tho
credit to which tlio olllcers wero respec
tively entitled. What I have to double,
therefore, Is whether or not Provident
MoKiuley did an injustice in tlio matter,
This necessarily involves a, comparison
of the action ot the dlfforout command
ers engaged, Tho exhaustive otllcial rt -
ports ot tho actiou leave little to be
brought out an jw; but as the quo.tlun
of Admiral Sampeou's right to bo con
sidered in chief command, which wasde
tormlned in his favor by President Mo
Kiuley and iMor by tho Court of Claims,
has never hitherto been olllulally raised,
I deemed it Ixwt to secure staUmuuts
from the commanders of the Ave ships
(other than thoUrooklyu and New York)
whloh wero aetlvely engaged In tho fight."
The Prejldent then inelude the state
ments from tho live Captains and says:
"The question as to whloh one of the
twJ men, Ai'm tal Sampson or Admiral
Schley, was ui the time in command Is
ot merely a nominal character. It was
it captains' fight.
"Therefore tho oredtt to whloh eaoh
of the two Is eutitled, rests on matters
apart from tlio claim ot a nominal com
mand oyer a squadron ; for, so far as
tho actual fight la concerned, uelthor
one nor the other in fast exercised any
command, batupsou was hardly more
than technically in tho fight. Ills teal
claim for credit rest upon bis work as
eomniaudor-lH-ohlef; upon the excel
lence of the blookadet upou the pre par
ed ness of the squadrouj upon the ar
rangement ol the ships ahead la a semi
circle around the harbor, and the stand
ing orders in accordance with which
thoy constantly moved to tho attack of
tho Spanish fleet when the latter ar
rived. For all those things, the credit is
his.
"Admiral Schley is rightly entitled
as U Captain Cook to tho credit of what
tho Brooklyn did In tho fight On tho
whole she did welljlmt I agree with tho
unanimous finding of tho three Admirals
who composed tho Court of Inquiry bb to
tho "loop." It seriously marred tho
Brooklyn's otherwiso excellent record,
being in fact tho ono gravo mistake made
by any American ship that day,
"Personally I feel It would have been
well to have given Captain Clark, of the
Oregon, the advisement that was given
Walnwrlght. But waiving this Is evid
ent that Walnwrlght was entitled to re
celvo moro than any of tb othor com
mandors.nnd that It was just to Admiral
Sampson that ho should rccolvo tho
greater advantage in numbers than Ad
miral Schloy there was nothing dono In
tho battle that warranted any
unusual reward for either.
In short, as reuardn Admirals
Snmpson and Schley, I find that Presid
ent McKinley did substantial Justfco.and
thero should bo no wainmt for reversing
his notion.
"Both Admirals Sampson and Scliloy
aro now on thu retired list. In conclud
ing their report tho members of tho
Court of Inquiry Admiral Dewey,
llenhnm and Komsey unito in stating
that thoy recommend that no further
action bo had in tho matter. Willi this
recommendation I most heartily concur.
Thero is no excuse whatever from either
side for any further agitation of tnls un
happy controversy. To keep it alive
would morely do damogo to tho Navy
and to the country."
