Humphreys. Ho was in dicted undor the warehouse act for n ohortago ot from 8000 to 12000 bushels of grain, in his warohouso accounts. Tho attorneys for Humphreys, S. L. Hayden and S. T. Richardson, asked change ot vonuo from Marion county to where an unprejudiced trial could bo securod. Tliey except Marion, I.lnn, ClackamaB, Washington, Laue, Polk, Henton and Yamhill counties. To support their motion a list ot aflldavitsworo presented by each side, regarding the matter of the prejudice ot tho people. The state hold that as every caeo of this nature yet tried had resulted iu acquittal of tho defendant there could bo no claim of partiality set forth, rather tho opposite, W, R. Smith was tried this afternoon on thu charge of assault with intent to kill having been Indicted by the state. On Decern bo r '22 last Smith asraulted J. R, Hinklu at Silverton, stabbing him three timtis in the left side. Hluklo recovered from tho wounds audnppcarod at the tho trial. W. H. Holmes is Smith's attorney. Townsend is accused of tho theft of a horse from tho range of Grant county and this is the second arrest which haa been made during tho past 10 dsys as n result ot tho work ot the stockmon, who have banded themeolves togother with tho determination to break up tho "rust ling" that thoy think lias been going on in Grant nnd Gilliam counties for several months. Tho first arrest was Tom Kano and was mado hero ten days ago. He was takon to Gilliam ciunty on the chargo of selling a horse that did not be long to him, nnd also for tho taking of one horse which was sold in La Grande, and it Is said that he disposed ot several head that have beon recog nized as stolon property. He came hero a week ago and had been on a drunk most of the time since until his arrest.
