WRIT OF REVIEW In the Matter of Experting Marion County Records Legality of the Proceedings Argued In Circuit Court This afternoon In tho equity depart ment of tho circuit court, tho caso of F. W. Durbln et al, vs. John H. Scott, et nl, a suit for wilt of review camo up for hearing. District Attorney J. N. Hart and Deputy J. N. McNary represented the county court and John A. Carson and M. W. Hunt appeared for tho county ollli'iaU. The caso was considered merel) from tho legal standpoint. A brief nummary of tho facts loading up to tho commencement of this suit show that on0!lobcr21, County Judgo Scott notified tho county officials that Messrs. Clark and Ruchanan, whom ho in troduced to them, had been engaged to export tho books nnd re ords of tho eovoral county offices. His motlvo for the action ho attributed to his interpre tation of a certain point of the law, which reads as follews: "The county court of tho several coun ties of tills state, whllo Bitting for county business at the ngular terms in January and July of each year, shall carefully examine ull books and papers rolating to the financial affairs of tho county clerk of the circuit court, recorder of convey ances,! reasurer and sheriff of tho scvoral counties." All of tho olllcers objected to thebookb being examined, inasmuch ns iio order ol the court uavo authority for tho act, tho work would entail an expense oi sesural IhotiFaiid dollars, tho men en gaged were not residents of this county nnd their reputatioufor this work else where was not good, nnd that tho work would probably havo to be dono again next Juno at the expiration of tho pres ent terms of office. Mr, Scott then called a special session of the court und tho order was mado p.oviulng for the oxportlng o! theso books. This was dono on Oct. 25, and Judgo Scott requested tho clerk to entor the contract on tho court records as caving been mado on Oct. 24. Carson &. Hunt, as attornoya for tho olllcials, on Oct. 2S, filed a motion with Judgo Scott that tho order bo revoked. This was disallowed on tho ground that it was a sham, frivolous and scandalous. An order was next mado by tho county court providing for tho county Judgo to oxamino tho records and retain Messrs Huchannn und Clark as assistants or clerks. Tho officers next petitioned Judge Doisofora writ of roviow, which was granted and "directed to tho county court, causing all orders and contracts toboaniilled, sot nstdo, reversed and held for naught," nnd serving as an injunction to furher proceedings in the matter of examining tho books. This was sot for hearing on November 0, aud tho only other action taken pre vious to this time was tho filing of a paper with the county judge by tho men engigedby him to do tho experting. this aeked the officers to namo two men to superintend their work, seeing that all was properly dono, ThlsreceivQd no at tention whatever. On tho flth the mat ter was postponed ono week. Although tho technlcolitles of tho question aro being tried, a groat deal of personal fouling has been devbloped In tho affair. The officers bolieve, as do most others, that thoro can he no necessity of tho action at the present timo.' Stephens, a pio neer of Salem nnd Afarion county, occur red at IiIb homo In North Snlem, at mid night on Friday, Novoinbor 15. 1001. Ho ha been ill with a complication of dis eases for n number nl wuek Mr. Ste phens was born near St. fouls, Mlsfonn, on August 17, 1817 He eroded the plains with his parents in 13-11) and lo cated in Salem where ho hna reidcd sinco. He woh married to Misa Marv Jane Myers in Santa Cruz, Cal.,in April, 1872. Besides his wifo he leaves six children : Mra. Mary L. Ryan, Mrs. M. S. Mcln- tyro, W. W. Stephens, Jr., Jap. 8 Stephens, and the MiescB Annio and Lizzie Stephona. His mothor now re sides four miles north of Salem, Shn is Mrs. Lucinda Stephens. He also has threo sisters and n brother as follews: Mra. A. J. Prulttnnd Mrs. Sarah Basoy. Heppner; Mrs. Matthew Holbert and James Stephens of Tillnmock. Mr, Stephona was formorly post master at Liberty nnd was nloo for a number of years the superintendent of the Marlon County poor farm. Of late years ho managed n largo farm near Liberty, but recently moved with his family into Salem, having lived at Third and Shipping atroots in North Salem.
