Taxes Due Frctn County to State Are Debts and Draw Interest Attornoy-Genoral Blackburn has ren dered to State Treasurer Mooro an ox hauativo opinion covering tho question of tho liability of a county in tho Steto of Oregon for Interest on state tnxca af ter tho samo aro duo and payable Tho question comos up over n claim which tho Btate holds against Washington county for $13.08 of the University tax of 1882 nnd $0,700 of tho state tax of 1895, and tho collection of which 1ms been in tho courts for somo years. Wo8hIngton county now offera to pay tho principal in full, but Is not willing to pay any interest. Tho Attorney General recites tho fact that during tho pendoncy of n suit insti tuted by the State of Oregon ngalnBt Washington county for tho collection of tho amount duo with interest, a similar action against Marion county waa tried nnd determined in tho supreme court, In which decision it was held that tho etato could not collect Interest on delin quent taxos duo tho atnto, because such taxes woro not paid within SO days after tlioy bocamo delinquent, the reason given being that the state by legislation had hiudorod tho collcotiou of taxes by the county, bo that it waa nn impossibil ity to colloct and pay over tho amount duo tho state within tho timo pre scribed. Tho principal proposition to which Judgo Blackburrt addresses himself mid which seems to bo tho hinge of tho dis cussion ia whethor or not tho statu tax from each county la n debt in tlio legal Bensoof tho word. Ho quotes from Judgo Thayer in State vs. Multnomah county, 13 Or. 237, who, In construing Sec. 3037 of Hill's codo, nsed the following Inngu ago: "Thoro can bo no interest unless thero id a debt, except whoru it is allowed ns damages nnd then tho party recovers in terest becnuse ho lias bean deprived of the uao of tho monoy or proporty from which ho could havo derived profit or saved less: and a tax is not a debt." Of this ruling. Attornoy-Genoral Ulackburn says: "lean not think that tho section of our statute on tho subject of Interest has been properly construed nor do I think that a tax due from tho county to tho Btnto ia not n debt: I, thoroforo, cannot yield tnv assent to the statements of law in said opinion." Mr. Ulackburn then examines Section 2780 of Hill's codo nnd holda that when tho taxes aro apportioned asthorein pro vided, and aro charged to tho county by tho Stato Treasuror thoy hocomo a bona lido debt from such county to tho state and becorao duo nnd payablo aa soon aa a siifllclent amount of monoy applicable to tho payment ot tho general indebt edness of tho county has boon collected by tho Sheriff nnd paid by him to the County Treasurer ; and the county ia not ontitlcd to delay tho paymont of its apportionment. Mr. Ulackburn quotes from 1 Or. 369, which construes tlio law as fixing the rotation of tlio county to tho stato In tho matter of taxes to bo that ot dobtor and creditor; also 24 Or. 1 14, which says that "tho effect of tho law Is to create the relation of debtor and creditor between the countloa and tho state," also 31 Or. 530, to tho samo effect nnd to tho further effect that tho etato tax "Is payable by tho county whether collected from tho taxpayer or not." Following out theeo laws aud construc tions tho Attorney-General holds that the tax ia a debt; nnd that tho country ia liable to interest niter tho samo bo comes duo, nt tho samo rate aa nn in dividual would havo to pay to another after his debt becomo duo. Ho closes tho opinion as follews: "It Is my opinion that tho amount of stato revenue apportioned to Washing ton County was and is nn indebtedness from said county to tho stato, that it bocamo duo and payable within a reason able time after an amount ot taxes duo said county sufficient to pay tho same had been collected and turned over to tho County Treasurer of said county, mat tlio county nnd no legal right to divert such money or any part thereof to, or use it for, any other purpose than tho payment of its share of tho stato revenue and that tho county ia liable to tho stato for Interest at tho lawful per cent from and after tho expiration of a reasonable timo to pay tlio samo to the state alter it hail been collected and turned over to the County Treasurer of said county."
