Not Responsible for the Death or Mrs. Hitch,
of Forest Grove.
At Hillsboro, last week tho domurrcr
to the complaint in tho caso of John
Hatch, a minor, against 8. W. Fletchor,
of McCoy, for $8000 damages, was ar
gued In tho circuit court. This is tho
caso which resulted from tho death of
Anna O. Hatch, of Forest Grove, and
tho plaintiff contended that Fletcher was
responsible for her death, and ho had
been actually damaged in tho sum of
13000, and asked for $5000, additional, as
vlndlcttvo damage.
Tho attorneys for Fletchor contended
that no caii60 of action existed; that if
any wrong was done to Mrs. Hatch, it
was with her consent, and that iu such
cases tho law does not provldo a right of
action in an heir or administrator. It
is claimed that if any cause of action
existed it abated with tho death of Mrs.
Hatch, Tho court sustained tho do
murrer, and stating that tho caso did not
admit of amendment, dismissed tho
action. Flccthor, voluntarily appeared
In tho action.

Tlio condition of Win. England is re
ported to bo unchanged. Ho was takon
to tho Palom Hospital Friday last in

John Murphy, proprietor of the
Murphy Tito Works, is making a sub
stantial improvement at his rcsldonco in
North Salem in tho shapo of a water
tower and Bystom of Are protection.
Tho tower is 75 foot in height and will
bo surmounted by a largo windmill and
a Itedwood wator tank of 4000 gallons
capacity. This will give a good pressuro
and an ample supply of water for all uses
about tho placo as well as (or uso in caso
of fire. Gribwold and ChaBO are doing
tho work.
Street Commissioner Frizzell has sev
eral men at work at tho crossing of Com
mercial and Ferry Btrcots. Ho is put
ting down cement cross walks across
each street from tho Willamette hotel
cornor, which will bo a great improve
ment ovor tho old woodon ones. A
cement sidewalk is also being put down
by tho street commissioner in front of
tho property on tho corner, bolonging to
Postmaster Kd. Hlrscli. Tho streetcom
missloner Is doing this work for Mr.
Hlrscli, and to Mr. Frizzoll'a energy and
good management, is due tho fact that
tho two jobs aro bolng dono at this time.
Mr. Aunsmor is Just completing a largo
hay barn on tho Ave acre tract in South
8alem recently bought from Mr. Finch.
Sheriff Frank Durbin is having his re
sidence of tho corner of Court and 15th
streets remodeled aud greatly improved.
