May 7, at 2:40 a. m. nt Jeffernon aged
02 year.
Her demise was not unexpected, as
slio hrnl been linKoring on tho vcrgo of
the shadowy land for several days and
It was thought eho had not many hours
life on Saturday. Hut sho lingered
amid hor circle of loved ones until tho
dawn of another week nnd panned away
in painless sleep, her mind remaining
unclouded to tho last.
urnndma Joone'i maiden hnmo was ,
Ituby Crawford Bend. Hho was born I
March 18, 1008 near Covington, Ken
lucky. At tho ago of nine years alio,
with her parents removed to Alabama,
and on March 10, 1827, she was married i
to Jesse Loonpy, anativo of Tennessee.
Mr. and Mrs. Loonoy come to Oregon
In 1843 with a family of six children,
crossing tho plains. To them more,
children wero born In Oregon and ten
are now living. The flvo sons and fivo ,
daughters wern present at her bedside. ,
Grandma Loonoy Is believed to lx) tho
last pioneer mother of 1813 who brought j
hor family to Oregon overland. Hho
was descended from revolutionary
stoek, one of her ancestors Itolng George
Walton, tho first governor of Georgia,
who was n signer of tho Declaration of
f ndependenco and also of the Articles of
Confederation.
The supremo court of Oregon affirmed
the decree in the suit brought against
Multnomah county to enforce a privato
tax collecting contract.
Tho suit was brought to annul and dc-
claro void a contract entered into which
provided that a private lawyer, one
Noble, should collect tho delinquent
taxes of 1887 nnd 1805, prepare corrected
tax lists, etc., and recelvo as corapensa-
lion all stum received by him in excess
of tho amount of tho tax and its actual
cost lawfully expended.
The supreme court holds that the
plaintiff comes within the rulo that an
individual taxpayer may, by n suit in
eouity, restrain tho misapplication of
public funds or property. Continuing,
the opinion says, in part:
"Tho plaintiff Is entitled to maintain
this suit if tho contract is void, as we
think It is. It is not only in effect as an
agreement by tho board of county com
missioner to use the genoral govern
mental machinery in the collection of
delinquent taxes for tho benefit, prima
rily, of a privato Individual, but it un
dertakes to interfero with tho discharge
of tho duties as;gned by law to other
'officers, and is, therefore, beyond tho
jiowor of tho board of commissioners to
make. It undertakes to Inter
lero with (he duties of tho county court
