Trusts founded on ficticious value gtven by special leglsla tlon might bo controlled by law, or forced to go to pieces; but those founded on legitimate business principles could not. Ho thought socialism tho only solution of tho trust problem. A. W. Dennis took a pessimistic view of tho situation. Sherwood agreed with Powers and Dennis, that government ownorshlp was tho only way of controlling tho trusts. Ho took no tho Texas anti-trust law and said said that since tho Standard Oil Company had been drlvon out of business in that stato, tho business had fallen Into tho hands of smallor dealers, who immediately raised tho price, and the peoplo of Texas might bo exjiected to soon commence calling for tho Stand ard Oil Company to come back. Ho outlined a plan by which tho govern ment could tako over tho trust's proper ty and business at a reasonablo valua tion. Tho trusts had shown us how. Tho trust Is a scientific way of doing business. It has taken hundreds of years to loarn how to do business on scientific principles. Aro wo going to tako a step backward now? Anderson vs. tho Portlanl 'Flouring Mills Co. involved n question of great Interest to tho farmers who had wheat itored iu tho Salem Flouring mills when thoy burned. It has been claimed by somo that thoso farmers who held only load checks for tho wheat thoy had lu tho mill, would stand on a different footing from tliofo who held warchouso receipts which contained a provision roloaslng tho company from liability In caso of loss by tho elements. In deciding this point, tho opinion, which was written by Judgo Bean, says: "It is claimed that tho load checks constltuto tho contract under which tho wheat was received. But tho avldcnco shows that when a farmer de livered a load of grain tt wns tho custom to give him a load check as ovldenco thereof, and when he comnleted his sea- 8on'shaulttig a recolpt wns issued for tho ontiro amount of eraln delivered nnd hence tho load checks do not evi dence tho contract under which the wheat was received, but aro simply memoranda of each load of wheat as ft was dollvered." It was held that parol vldonco was competent to show that wheat, for which load checks wero issued, was re ceived under tho samo contract as wheat for which receipts woro issued. This seems to scttlo tho status of tho load checks, as tho farmers holding them probably all intended to tako re ceipts as soon as their wheat was all In.
