theless managed to Indict on his hand

curious story of tho snnio kind comes

Mr. Ilayloy, alio an artillery officer,
was charged by a wouuded tlgor which
hu was following up. Ho missed It
with his ilrst barrel, and tho second
failed to go off. Tho tiger sprang, nnd
Mr. Ilayloy Jumped to ono side, thrust,
lug out his rlllo to keep tho bruto off.
Tho tiger, It Is stated, seized tho bar
rcls and droro his teeth through them
and, being mmlilo to withdraw them,
was shot by Captain Harrison, Mr.
Hnylcy'a companion.
In his death struggle tho tiger drag,
geil tho rlllo from tho owner's hands,
nnd tlio Jar caused by tho stock strik
ing tho ground brnko off two teeth
which wcro Imbedded In tho steel. This
story Is said to bo absolutely truo; but,
with tho profoundest respect for the
strength of tho tiger's Jaws and teeth,

Mr. Sonnemann has not yet fully de
cided Just what he will do, nor whero ho

The abovo heading Just about covers
last nights production. The play Is a
pretty good melodrama. With n stronger
company would be better worth seeing,
but on the whole perhaps It was as well
rendered, as could be expected consider
ing dreary expanse of empty seats to
A-hlch tho company was playing.
Tho scenery belonging with the piny
was excellent, especially tho pawnbrok
er's shop and tho Fleet Street scenes.
The company was fairly good. As
Jack Ferrers, Lawrence Qrllllth probably
carried off tho honors, though his exag
gerated style of delivering tho dramatic
lines dotractcd from tho effect.
As Gladys, Margaret Lewis was very
good, though handicapped by a lack of
voice.
As Katie, little Neseel Lewis filled her
part with remarkable naturalness.
Ono reform should bo Instituted by
Pntton Brothers without tho delay. Tho
curtain should go up at 8 o'clock Instead
of 8:30. There Is no sonso in dribbling
along till half-past eight before the play
starts, only to bo kept until after 11
o'clock to sco it finished. All could
reach their scats by 8 o'clock us easily as
half an hour later, but no ono cares to
do so now when it only Involves n half
hour of dry waiting. An announcement
of this reform, lived up to on one or two
occasions, would cure tho evil.

bound over to the circuit court In the
sum of 1250. Being nimble to furnish
tho required amount, ho was committed
to jail.

tlco of tlio Peace Johnson this forenoon
for his preliminary examination on the
charge of being one of tho men who helu
up Hoefer nnd Zorn, near Chnmpoeg
last Thursday evening, nnd robbed them
of nearly $100.
District Attorney S. L. Hnyden
assisted by Chas. McXary conducted the
case for tho prosecution, whilo L. II.
McMnhan defended the accused.
The first itness placed on tlio slnnd
wnlCaiporZorn. Ho retailed the facts
of the robliery, as already given In The
Jot'tt.VAL, nnd positively Idontlfled Wes
ton as one of the men ; know him by his
ow n actions, slzo and general appear
ance. Mr. 2orn was kept on tho wit
ness stand about an hour.
Tho next witness was Jas. Loudon,
one of tlio hired men, who was present
nt tho robbery. Ho also was positive as
to tlio identity of the accused. Had
known him 10 or 12 years. Know his
voice nnd manner of talking, his build,
size and walk. x
Had recofciiized him at the tlmo nnd
he and Zorn had both spoken of it inv
mediately after the robbers had gone.
Lester Sprnguo wus called but did not
profess to havo recognized cither of tho
robbers. Cross examination brought
out a corroboration of Zorn's nnd
and Loudon's testimony that they had
mentioned Weston as one of tho robbers,
at tho time.
Other witnesses not having arrived
court adjourned at 11 o'clock to meet at
1 p. in.
At 1 o'clock tho prosecution rested,
having no more testimony to introduce
The defense then put four witnesses
on the stand to prove that Weston was
in Portland at the time the crlmo was
committed. They were: A. W. Jetty,
who with hlswlfo, Weston's sister, keeps
a boarding houso at 330 Fifth street,
Portland ; Mrs. Kruger, who works thero;
nnd a gentleman and his wife who board
at tho houso.
All four testified positively .to seeing
tho defendant nt said boarding house on
tho evening of Tuesday, tho ffijnl, tho
evening the hold-up occurred at Chnm
poeg. This concluded the testimony, und
utter it short summing up by McMnhan
und Hayden, .Justice Johnson dlsmlsd
tho case and discharged tho prisoner.
