Oregon Statute Does Not Authorize Ap pointment of Receiver for Insol vent Corporation. Judge Clclaml, of Portland, has de nied tho petition for tho appointment of a receiver to tako charge of tho affairs of tho Kaupisch Creamery Company, on the- ground that tliero was no showing in tho complaint to warrant tho ap pointment of a receiver under the law. Tho petition was Hied by J. C. Mar garth, II. W. and M. M. Kaupisch, stockholders in tho concern, who al leged that they and M. C. Uanllold and Thomas Hand, and other stockholders, wero unable to transact business to gether, and that tho company was in imminent danger of becoming Insolvent. It also stated that numorous attach ments had been filed by creditors. ltecuivcra have frequently in tho past been apointed on petitions of this kind, and the decision of Judge Cleland refus ing to appoint tho receiver was a sur prise to counsel for the jx'titioners. The statute upon the subject of receivers is Is as follews: "A receiver mtiv lie nnnolntod in nnv civil action, suit or pioeoeding othe'r tint ii an action for the recoverv of soee- Hie personal property, "Pievioitslyliefore ludimient or decree on the application of either party, when his right to the property which is the subject of action, suit or proceeding, aud which is in posessiou of a third party, is probable, and the property or its rents or profits aro in danger of lieing lost or materially injured or impaired. "In cases provided for in this code, or liy other statutes, where a corpor ation lias been dissolved or is insolvent, or is in imminent danger of insolvency or has forfeited its corporate rights.1' This last clause fits tlio present case, but there is a missing link which de stroys its intent. It begins by saying: "In cases provided for in tills code, or by other statutes." This means that other statutes will relate when it is proper to appoint a receiver under thin clause of the law, but, unfortunately. there are no other statutes upon the subject. It is true there are receivers now in olllce in like cases, the Portland Savings batik for instance, Portland hospital, Hrowcr it Thompson Lumber Company and a great many others. Attorneys liloomllelil aud Joseph, for the petition ers, called attention to those cases, and strongly urged that the statute is plain that a receiver bo appointed when a corporation is in imminent danger of insolvency, so as to protect tlio stock holders, and it was contended in tills case that tho assets largely exceeded the indebtedness, and that the prop erty, if judiciously handled, would pay all ot the Hunts, ami the petitioners also reali.e something. The appoint ment of a receiver was proju-r under these circumstances. Attorneys Wirt Minor, A. King, Wil son and Cecil Uauer, representing at taching and other creditors, argued considerably according I o tho court's opinion of tho law that a receiver could not lie npiHiiutcd on the showing pre sented. Jiulgo Cleland has previously expressed himself upon this law in pass ing upon another case, so his ideas in tlio matter aro known to many members of tho bar. Ho adheted to his former recent opin ion in refusing to appoint a receiver in this proceeding. Tho question was raised in the Port land hospital leeelvership. In that case tho company which holds n mortgage on tlio building tried to defeat tho claims of certain creditors against the receiver, on the plea that the appointment of the receiver, to legiu with, was illegal. Judge Cleland held that while that was deubtless true, the receivership was a fact, aud had been permitted to exist ami do business without any protest by tho mortgage company or any one else Interested, aud they wero stopped from raising tho issue now. Tho court would probably make the same ruling in tho Portland Savings hank, ami other re ceivership cases, hut Judgo Cleland, while holding that tho old receiverships of this kind will stand law, does not in tend to appoint any nioro such receiv ers. Judge Cleland also made a ruling, not long ago, different from that formerly in vogue, in the mutter of the appoint ment of rccoivor to collect rents during tho jieniluncy of u mortgage foreclosure suit. East of tho Cascade range is n vast plateau, varying in elevation from about 2000 to 5000 fcot above kd lovol, and similar in gen eral character to the plans of Idaho, while south of this is that part of the Great Basin which extends into Oregon. It is in this eastern part of tlio stnto that much the greater part of the public lands are situated, nnd rough estimates show that they include fully 1,000,000 acres of agricultural land, besides largo areas of grazing land and timber. Wheat and other cereals aro grown horo also without Irrigation, but not without risk of failure from lack of rain ; and irriga tion is practiced to considerable extent, thousli mainly as yet by means of short ditches. There are numerous small rivers tributary to the Snake and the Columbia, and while most of tho water now runs to wasto in the early spring, it is estimated that by constructing leservolrs and using artesian-well waters aliout .'1,000,000 acres in Kastem Oregon can bo irrigated. Where irrigation Is practiced tlio cereal crops aro usually supplanted by the raising of fruits, veg etables, and forage crops. Besides ag riculture and stock raising, mining is carried on to some extent in Oregon as in the mountains farther west. Tliero aro several railroads in tho Willamette valley, and the Willamette river is navigable throuhout more than half its course. Other railroads run along the northern border and across the north-eastern corner of tlio state, but through most of Kastem Oregon there are no better means of eoiniuuni- cation than wagon roads.
