Both these Judges, and some of those who ate nou-commltlal, seem lo hold that it were Impossible lo limit the power of the courts In this respect, because It Is Inherent in the Anglo-Saxon Jud iciary. The fact that the United States constitution, moreover vests equity powers in tho federal courts, would, In the opinion of s6mc, render laws curtaillnc the nnnllrnlinn r these powers unconstitutional. But the attacks upon "government 'by injunction" by some of the judges who hold views different from Judge Grosscup, are almost sensational. Judge Murray V. Tuley. chief Justice of the appellate court of Illinois, declares; When courts undertake to settle la bor disputes by the use of the writ of Injunction they are acting without jurisdiction. To use the writ of in junction to disperse or prevent an-un- lawful assemblage, or to patrol a pub lic highway with armed deputy mar shals' Is a usurpation of power by the courts. When "labor disputes' en danger the public peace or render the destruction of property Imminent, no good citizen can object to the execu tive branch of the government using Its "iron hand" to prevent either, but no amount of legal quibbling will sat isfy the people that the writs of In junction of the federal courts in the coal strike have not been Issued and used for the purposes and objects a bove stated. Such use of 1 he writ of Injunction by courts Is judicial tyranny, which en dangers not only tho right of trial by jury, but all the rights and liberties of the citizen. I venture to predict that unless this usurpation of power by the courts Is promptly checked we shall within a few years see elections -and a presidential one perhaps car ried by a court's writ of Injunction backed by armed "deputies" or fed eral soldier. II Congress has the power it should promptly put an end to "government by Injunction" by delining and limit ing the power of the feberal courts In the use of the writ. We cannot quote all these judges In extenso, but the especially striking seulences appearing may be brought to the intention of the reader. Chief Justice McCabe of the supreme court of Indiana says; "In view of 'the lengths to which the doctlno ("f 'Injunctions) Is now being carried, I 'am inclined to believe It would be 'best to place some legislative re 'strictions upon tho power of the courts In this regard." Justice Jesso J. Philips of the supreme court of Il linois declares: "The existence of 'such power may well be doubted, as 'may also the jurisdiction of courts of 'equity In such cases. It would be 'well for congress to limit and define 'the power of federal courts in Issuing Injunctions." Justice Walker Clark of the supreme court of North Caro lina says: "The practice of issuing 'injunctions In labor disputes Is with 'out warrant, reason or precedent. 'It Is a denial to the citizen of the 'right of trial by jury by judges who 'enact the law by their own decrees 'and then execute It by the penalty for contempt." Judgo Edward F. Dunne of Illinois answers that in junctions often Interfere with the constitutional guaranteel of trial by jury. Congress should limit the power of the courts, ho says. The Il linois supreme court "fore-haw the 'great danger which would arise from 'an indiscriminate and unwle use of the writ of injunction when It de- Junction is the law, 'indlspenlaoie to 1110 compiutu auunu 'istration of Justice, but liable to 'great abuse. It would not promote 'justice to extend -its use to cases of 'doubtful right, or where there are 'other adequate remedies.' Dickey & Heed, 78 111.. 201." Another very severe condemnation of the practice comes from Judgo John Gibbonsof the circuit court, who says; "In my opinion there Is a danger to day threatening the very existence of the republic, asglgantlcasthat which precipitated the relelllon and well nigh wrought the ruin of our Union. v, it. mines, as ever. Cbetaln writ- Injunctions should not issue where the sole object Is to repress public dis order, unless where property rltzhts are clearly violated While public order must bo maintained and riot and disorder repressed, resort should not be had to the writ -of injunction to prevent threatened criminal acts or to punish olTene or crimes known to the criminal law when a trial by 11 Jury of one's peers Is guaranteed by the constitution, for such use would clearly infringe the constitutional rights. It might bo desirable to more spccllically define by legislation the powers of courts in Issuing Injunc tions, but how far such legislation should go is a matter for legislative rather than judicial judgment. It Is unncssary to quote ex-Qov. Altgeld, Who Is so deeply In politics, but It Is worth while to quote this much from Ills answer: "I havo re ceived hundreds of letters from all oyer the country In reference to what I said lei Philadelphia, all or them agreeing lu the main With me. What is most remarkable about these com munications Is the fact that a great number of them come from judges, several of tlicm among the most prom inentand respected In the United Sta tes." The chief value of these opinions consists lu this, that they reveal to us the fact that so-called government by Injunction Is as odious to a large proportion of the judiciary its-elf as it is to the great majority of the people. When such bitter language on this new dcvelopement of judicial pr.wcr emanates from judges like Tuley and Gibbons, we may be sure that the power of Injunction may easily be abused and tliat no one Is necessarily an 'anarchist or an incendiary In thinking ;that it has been abused. The political party that sets out to support the extreme position of cer tain judges in this matter will have no easy handling by the people. As It is now, according to the Grosscup view, the power of the courts Isllmitcd only by tho court's own discretion. If strikers may be enjoined from making public demonstrations be cause of tho injury they may do, why may they not be enjoined from strik ing at all ? The very act of striking often does "irreparable injury" to an employer's Interests. The Judiciary should take warning from the present popular feeling, elso a further exten sion of the injunction process will arouse a storm that none of us will care to face. Regarded as a Duty.
