In an interview regarding the many liundiecl claims that are being forwarded to the secretary of states ollicc to await Ills action as state auditor, Secretary of State Kincaid today said: "More than 1,800 claims against the state liaye been tiled with the secretary of state during the present year, and arc now awaiting payment. For eacli of these cla'ms two vouch ers have been issued, an original tiled in thcolllceand a duplicate handed or sent by mall to the claimant, mak ing more than 3,000 vouchers 'Which have been made out. This has made about double the usual amount of work In the onice of the secretary of stale, and the work Is now only half done, as each - of these claims must again be examined, under the opinion of the supreme court, which will per haps soon be handed down, and the most ditlicult and complicated part of the labor is yet to bo performed, in comparing each of the various classes of claims with the general laws and the opinion of the court, instead of with the appropriation bill. 'The claims referred to, for which t vo sets of vouchers have been Issued and which are now pending for set tlement, do not Include the claims of the militia, amounting to $30,000 a year, and the state university, a unting to the same. These claims, numbering about 400, have bjen audited and warrants drawn as fist as they come In. Nor do the 3,000 vouchers and duplicates, referred ti, include claims from any of the 'homes' at Portland, Beaverton, Mt. Angel, Salem and Albany, to which about $20,fOO per annum has usually been paid; nor the normal schools to which about $20,000 per annum has been paid; nor the railroad commis sioners, the food and dairy commis sioners, the llsh and gamo protector, the state fair, and the various other district fairs; amounting in all to nearly $100,000 per annum. . Under the opinion of the su preme court these reiected claims, which will nearly equal In number the claims heretofore referred to as al ready tiled, will nourln again and must be disposed of by allowing them, or by disallowing them and re port them to the legislature. "Perhaps the claims for the fairs' which are authorized bylaw, will be audited under this decision of tho courts but all the others will probably be disposed of by disallowing and re porting them to tho legislature. Then there are numerous claims held by sherllTs for conveying convicts and Insane, which they have not desired to 111c with the secretary of state, preferring to retain them until there is an appropriation to pay them." Mr. Kincaid receives, dally, numer ous letters requesting him to audit and pay claims against the state. These claims arc herewith respectfully returned to you, for the reason that, in my Judgment, they are not valid clalms.agalnst the state, as has been rcncatedly stated heretofore, and have no right, under the law, to bo filed In the otllce, not being In tho nature of a deticlency but an original demand for money, which the legislature must pass upon favorably before tills ollicc can have jurisdiction.
