Terrell and Commissioners Davis and Watson, sit ting as court, The nomination of Commander II. W. Smith, or Sedgwick Post No. 10, by the members or that company, to the otllce of disbursing agent, for the Indigent soldiers fund, was today ap proved by the county court. Jones, traveling salesman for a San Francisco confectionary house, was a passenger to Portland this morn ing having made a brief visit with his family In this city. Mr. Jones re ports tho holiday trade In confections as being exceptionally good. Ills houso was obliged to refuse orders amounting to 10,000 pounds, or line candles. The trade of tho nast year by far exceeded that of 1895, notwith standing tho prevailing "hard times." Originally Mr. Jonas territory con sisted of Oregon, Washington, Cali fornia, Idaho, Montana, Utah and Neyada but since tho territory was too largo In which one man could look after tlio Interests or tho company It was necessary to restrict Mr. Jones to Oregon, Washington, California and Idaho. Stato Superintendent G. M. Irwin went over to Corvallls this morning to attend tho regular semi-annual meeting of tho board of regents for tho Oregon Agricultural College, lo cated at Corvallls. Gov. W. P. Lord, Secretary H. R. Klncald, Hon. IT. W. Davenport, and otlior members of tho board were unablo to go owing to so much work demanding tlioir atten tion preparatory to tho meeting of tho legislature. There Is no business of general importance to come before tho board for lus consideration. ROWLLEY. At state insane asy lum, on Tuesday, January 5, 18U7, Martin Rowley, aged 5!) years. Deceased was born In Leltrim county, Ireland, and at the age of 0 years came with his parents to the United States, settling In Minnesota. In 1802 ho came to Oregon, locating In Marlon county, where he was mar ried to Miss Clara Yost, with whom he lived happily until tier death In 18U5. He leaves four sons and one daughter, who Is married. Two sons and the daughter reside in Minnesota. Harry and Frank.agcd 17 and U.years, respectively, reside In thiscity. Shortly before Christmas Mr. Rowley was taken ill with la grippe and a few days later facial erysipelas set In. On Tuesday arternoon Mr. Rowley had been sitting up and at 5 o'clock remarked that, he must He down when he expired almost In stantly, t Mr. Rowley has been an employe at the insane asylum Tor the oast eluht years, serving iu tho capacity of night watchman and supervisor. Mr. Rowley was a member of Pro tection lodge. No. 2, A. O. U. W.; past master of Salem lodge, No. -1, A. F. & A. M and a member of .Multnomah Royal Arch Chapter, No. 1. Funeral services will be conducted at 2 p. m., Thursday, from the Insane asylum, under the auspices of the Masons. Rev. J. Rowcrsox, of the United Evangelical church, will mako a short address over the remains after which they will be takeu in charge by tho Masons. Interment will be in the I. O. O. F. cemetery. I J. The court says it is not based uqon anything in the con tract, but claims of false representa tion in regard to the character extent and value of property-sold are made. After a lengthy review of the evl- rtpnefi in the case, tills court holds that the evidence was insufficient to justify the submission of the case to jury, and that defendant's motion for a nonsuit should have been granted; also, that the trial Judge In ruling upon the motion for a new trial ex pressed dissatisfaction with the ver dict and stated that lie would hayc found differently had he been a Juror. Ilutton fared the same as Mr. Gobalet, and was duly elected. The present corps of men In the Are department was recommended by Chief Hutton, and all were unani mously re-elected. Uranson and others, for a new side walk on the north side of Center street, between Commercial and Lib erty; also a crosswalk across Coaimer- cial street at said Intersection. Re rcrred. City Treasurer Swafford was present and stated to the council that Inas much as he was having some difficulty In obtaining new bondsmen, requested that the council inform him Just what kind of a bond it required, stat ing also the amount or the same. He Mated that his friends hesitated about signing a new bond until the shortage caused by the Williams & England bank failure was properly adjusted, and for that reason presented a draft of a new bond, which is like the old bond except the following provision, which Mr. Swafford suggested should be inserted: "And It Is also understood nmi agreed to, by the common couucll of nit uij ui ouiuiii, anu tiereoy made a part of this board, that the above named sureties of the said E. J. Swar ford, shall, In no way be hold to be liable for auy previous act of his or ills sureties, during his conduct or sild otllce, prior to the date of this instrument." Mr. Holman moved that the matter of a new bond be referred to the proper committee, with Instructions to secure legal advice upon the mat ter and report to the council.
