Justice Brewer of tbe Uni'ed State
supreme court has decided that tut
maximum freight rate law of Nebraska
Is constitutional, but declares that the
rates named Id the law are too low,
Ho therefore orders that the rates re

earnings of the railroads will justify the
proposed cut in rates.
The Nebraska law has been sus
pended In the courts a year and a-half,
the reduced rates having never been
put In force. Judge Brewer decides
that the proposed cut in rates would
have been unjust and unreasonable be
cause railroad tratlic has declined
enormously the past two years. But
all other business has declined pro
portionately and tho farmers and
laborers especially have been obliged
to sutler enormous reduction in their
Incomes from wages and prices of pro

Railroad managers have great reason

those earnings are consumed up to u
given point and freight rates need
novor be lowered oxcttpt by such com
