Tho state of Oregon should pay tuoru attention to jotting general -tato tax out of stock watering cor porations. The supreme court of ihe United States ou the 11th instant teudered n decision sustaluiug the validity of the Pennsylvania law pioviding that tho Pullman Palace Car company should pay tax on Its property within tho state, the amount on which it was to be assessed to be found by ascertaining the proportion which the number of miles of road within tho state over which the company's car run boro to the total number of miles In the United States over which they rati, and then dividing the capital stock of the company by the proportion. It was contended by the company that this law was unconstitutional, for the reason that it was a regula tion of interstate commerce, and that its cars could 1)0 taxed only in the state of Illinois. Justice Gray ruled that it was not a liceiis-o or a privileged tax, but a tax applied equally on all tho corporations within the state, whether engaged in interstate transportation or not. Tho tax on the company was em ployed, not because it was doing business in tho state, but because the cars were in the state and wen property, and they were taxed w hether they went on beyond the state's boundaries or not. Tho mode of taxation the state adopted, on a state mileage basis proportionate to tho total mileage of tho country, was au equitable and Jtmt method of settlement, and, if followed in every state, the company would be assessed on the whole capital stock, and uo more. The result of a decision that such a method of taxation Is uncon stitutional would bo that property employed in an v continuous mop incut would escape taxation alto gether. Justice Gray also announced that the court sustained the validity of the Massachusetts law under which tho commonwealth taxed the buildings, machinery and oihei property of the Western Union Tel egraph company within the state, first ascertaining and deducting the amount of properly of the company already assessed by municipal or local authorities.
