Lincoln, Nob., May 0. Tho su
premo court yesterday rendered a
decision in tho Boyd-Thayer quo
warranto case, ousting Boyd (dem.)
who at present holds Hie office, and
declaring Thayer, his republican
predecessor, legal governor of Neb
raska. The opinion recites tho facl
that Boyd was legally elected gov
ernor of Nebraska, but is disquali
fied on the ground of non-citlzen-ihlp.
Boyd accordingly turned
over the office to Governor Thayer,
who had In tho meantime taken thi
oath of office and filed his bond. It
Is stated Boyd will carry tho case to
tho United States supreme court.
Hoyd's ineligibility consists in the
fact that his father, who was a nat
Ivo of Ireland, fulled to ever perfect
his citizenship in this country, and
thus, Boyd is not an American citi
zen.
REPORT OF THE GRAND JURY OF
NEW ORLEANS.
New Orleans, May 0. After six
weeks' investigation tho grand jury
completed Its labors in tho Italian
case, and yesterday aftprnoou pre
sented a voluminous report to Judge
Marr. Tho report recites the killing
of Chief of Polico Hennessey, the
trial of tho Itallaus, etc., and refer
ring to tho verdict rendered, say:
"We cannot bo mistaken In the as
sertion that tho verdict wus startling,
amazing, a bitter disappointment,
shocking to public opinion, provok
ing ropeated accusation that some of
tho Jury havo been unfaithful to
their ofllce,"
"Wo aroled," continues tho report,
"to conclude that the jury under
took to try tho case when it was sub
mitted,by their own estimate of the
valuo of statements made by par
ties not called as witnesses. With
strango uuauhnlty they dwelt upon
what tlioy knew by reading and
horesay of certain incidents of tho
assassination pi ior to the trial, and
made those tho basis of powerful
persuasion for giving tho accused
the benefit of tho doubt, aud con
eluding deliberations in their favor,

expected to obtain auy ovideuco of

Jury,for those who were uncorrupted
had nothing to roveal, wlillo others

out by evidence of Jurors, that as

engaged in deliberation four or flvo
hours, and ou repeated ballots stood

neither personal motives nor inter
est. Following this Investigation it
was quickly learned that talesman

sion was that big money might be

machinery of the court. The evi
dence shows n list of names that
wero tampered with when drawn
for tho Jury and before they reached
tho jury box in court. O'MulIy was
put in possession of the list almost
immediately after the names were
drawn and before they readied the
district uttornoy'sofilce. Influential
friends alone could accomplish this,
but it was secured in tho person of
one of the jury commissioners lately
removed. It is further learned that
in tho ofilco of the detective agency
is kept a book of names and ad
dresses of jurymen. Of three hun
dred names drawn for February, a
panel of thirty-two were on O'Mal
ly's list, and lute us the talesmen
wero drawn, many more names ap
peared that were on that list. Truly,
business of this enterprising detect
ive agency was facilitated when
thirty-two names of their selection
could bo drawn on a panel of three
hundred jurors from a wheel con
taining ono thousand names.
Sufficient evidence, however, was
oflercd by voluntary and reliable
witnesses to justify the indictment
of six men, ns follews:
Thomas McCrystol and John Coon
oy, with D. C. O'Malley, for attem
pting to bribe talesmen, and Ber
nard Glaudi, Charles Granger, and
Ferneard Armant, for attempting
by each to bribe three different
talesmen. These parties are clearly
shown to have been intimate with
O'Malley, ofton in his office, infor
med of all doings, and were active
workers in jury fixing business gen
erally. Wo are forced to thu con
clusion that D. C. O'Malley is char
geblo with a knowledge of and par
ticipation in most, if uot all, of the
unlawful acts in connections with
that celebrated case. Without his
assiduous and corrupting influence,
wo believe the verdict would have
boon radically different, aud, as a
natural consequence, tho tragic oc
curences of tho 14th of March last,
nevor would havo been recorded.
Wo cannot fail to refer to tho Inti
mate relations existing between a
class of ward politicians and the
prime mover In all these Infamous
doings. Wo havo almost direct
evidence that a person holding the
position of inspector of welghls and
measures was often at the agency
and was seeu coming to the court
housn In company with a talesman
tho day he was accented ns a jtuor.

Interfered materially with the ar
rangements for tho reception at
various placet?, but did not suppress
the cordiality aud enthusiasm of the
people. It was 8 o'clock when the
presidential special reached Tacoma,
and tho mill seemed to bo coming
down harder than over. Notwith
standing this fact, the chief magis
trate of this country and his advisors
wore given a splendid reception.
They were met at the station by tho
governor of tho stute, the mayor of
this city and committee of citizens,
who escorted the party to the Gross
block where tho formal addresses of
welcome wero duhvyied. Tho line
of march and tho reviewing stand
were handsomely and appropriately
decorated. There were four grand
arches on Paulllo avenue, one made
of fir blocks, nnot hereof coal, another
of iron nud tho fourth of grain, all of
native production, hi Ida response
to tho addrcasea of welcome, the
president said: "I would like towel
some great steamship lines carrying
tho American Hag enter the ports of
Puget Sound. I bcliovo wo havo
come to fho lime In our development
as a people, when we must step for
ward with bold progress, or wc will

attained. We have within ourselves
the resources and market of which

I think the period of discontent with

people. Tbo time is auspicious for
enlargement of our commerce with
