Maupin of Woodburn came to an ab rupt end in tha rinit morning when Judge Burnett sustained liiQntuuun jor a nonsuit maJe by the ; attorneys -for the defense on the prev ious evening. , Mr. Maupin sued the rsiiroad company for $25,000 damages, which be alleged he sustained during October of last year through the care lessness of the company's employes wuiiw engage! is mi duties aa railway mail clerk. The last bf the plaintiff's wtiarsnrs was cauea to the stand on Tuesday evening and at the conclusion of hi testimony the attorneys for the : defense moved for a nonsuit. 'The mo tion was argued by the attorneys yes terday morning with the above' result. The criminal case against John Hoff man,, the alleged Woodburn bank rob ber, was called for trial at 1 o'clock yesterday afternoon and resulted in the acquittal xf the defendant. The case was tried by a jury composed of the following: P. W. I Collard. A. C Libhy, J. P. Davie, Cornelius Cooley, J. H.- Porter, E. J. Swafford, P. L. Ken ady, James imlah, Adam Snyder,' A. Dane, a !A. Hughes and KT A. Kurtz. Hixteea witnesses" were examined durisg the trial, nine of whom were railed by, the defense. Althongh sev eral of the witnesses, when examined at Hoffman's preliminary hearing, iden tified him as one of tha mea who robbed the Woodharn -bank last spriag, when called to the stand yesterday they were not. so-positive ia their identification; in fact, none would say positively that they hadr ever seen the defendant prior to his arrest.'
